I <br />- 5 - ~3- r~oos <br />shall at the option of the Banks continue until full payment of the Debt and <br />all other sums hereby secured or until title to the t~tortgaged Premises shall <br />have passed upon sale under foreclosure of this Mortgage, including any period <br />allowed for redemption. <br />11. The several rights, powers, options, elections, appointments, and <br />remedies in this Mortgage contained, provided, declared or authorized shall be <br />construed and deemed as cumulative, and no one or more of them as exclusive of <br />the other or any of the others or of any rights or remedies which are now or <br />may be hereafter given or allowed by law. The granting of an extension or <br />extensions of time for payment of the Notes or other evidence of the Debt <br />either to the maker or to any other person, or taking of other or additional <br />security for payment thereof, or waiver of or failure to exercise any right to <br />acceleration of the Debt under any covenant or stipulation herein contained <br />shall not in nay way affect this Mortgage nor the rights of the Agent and the <br />Banks hereunder nor operate as a release of any personal liability upon the <br />Note or other evidence of the Debt nor operate as a release of any covenant or <br />stipulation herein contained. <br />12. All covenants and stipulations contained in this Mortgage shall <br />bind the successors and assigns of Mortgagor and shall inure to the benefit of <br />and be available to the successors and assigns of the Agent and the Banks. <br />13. This Mortgage is given as collateral security for the Debt and <br />obligations of the Borrower all as set forth in the Loan Agreement. Any term <br />hereof to the contrary notwithstanding this Mortgage shall be released by the <br />Agent when required by Section 2.2 or Section 10.9 of the Loan agreement. <br />Notwithstanding anything herein set forth to the contrary, the amount of the <br />Debt secured by this Mortgage shall be subject to the limitation set forth in <br />Section 7.7 of the Loan Agreement. To the extent the terms of this Mortgage <br />conflict with the terms of the Loan Agreement, the Loan Agreement shall <br />control. <br />IN WITNESS WBEREOF, said Mortgagor has executed this Mortgage on the <br />day of January, 1983. <br />PESTER MARKETING COMPANY <br />1~„G.O~L.J <br />.
