Green, being first duly sworn, deposes and says:. <br />That he is a Vice President and Trust Officer of the National <br />Bank of Commerce Trust and Savings Association; <br />That Lila PA. Winter entered into a living trust agreement with <br />the First Trust Company of Lincoln, Nebraska and Richard E. <br />Stephens, Trustees, on June 24, 1458; <br />That among the property transfered to the First Trust Company <br />of Lincoln, Nebraska and Richard E. Stephens, as Trustees, on <br />June 24, 1958 was the: <br />Southeast Quarter of the Southwest Quarter <br />(SE/4 S!J/4) and a tract of land lying south <br />of the Railroad Right-of-Way in the North <br />Half of the Southwest Quarter of Section 33, <br />Township 11 North, Range 10 .Jest of the 6th <br />P.t~l., Hall County, Nebraska containing 55 <br />acres more or less; <br />That the First Trust Company of Lincoln, Nebraska merged and <br />consolidated with the National Bank of Commerce of Lincoln on <br />September 9, 1961 under the title "National Bank of Commerce <br />Trust and Savings Association"; <br />That Richard E. Stephens died January 16, 1912; <br />That on July 25, 1972, Lila M. Winter pursuant to rights reserved <br />to her in said Trust Agreement dated June 24, 1958, designated <br />James E.
