REAL ESTATE LIEN ~,"~'_... (~~~~~'~~ <br />WHEREAS Walter and Wilma Bernth, husband and wife, <br />(hereinafter usually referred to as "Homeowner", whether one or <br />more) has entered into a certain written HOUSING REHABILITATION <br />GRANT AGREEMENT dated the 1st day of December, 1982 with the City <br />of Grand Island, Nebraska, a municipal corporation (hereinafter <br />usually referred to as "City"), acting through its Community <br />Development Agency, for rehabilitation of a dwelling on premises <br />owned by Homeowner which are hereinafter described, and for the <br />granting by City to Homeowner of Federal funds in the amount of <br />Two Thousand Five Hundred and 00/100 Dollars ( $ 2 , 500.00 ) to be <br />applied in payment of the cost of such rehabilitation, and <br />WHEREAS, Homeowner in such AGREEMENT has, among other <br />things, agreed (a) to regay such amount or, as the case may be, a <br />part thereof to City in certain circumstances described in the <br />AGREEMENT, and (b) to execute and deliver to City an instrumen t <br />in recordable form granting to City a lien on the premises to <br />secure such repayment, <br />NOW, THEREFORE, in consideration of such AGREEMENT with <br />City, Walter and Wilma Bernth, husband and wife does hereby grant <br />to CITY OF GRAND ISLAND, NEBRASKA, A Municipal Cororation, its <br />successors and assigns, a lien upon the following described real <br />estate situated in Hall County, Nebraska: <br />South 52 Feet (S 52') of Lot Four (4) and the South 52 Feet <br />fS 52') of the West 16 Feet (W 16') of Lot Three (3), <br />Block One Hundred Twenty-Eight (128), Union Pacific Railroad <br />Addition to the city of Grand Island, Hall County, Nebraska <br />according to the record plat thereof, <br />to secure repayment to the City of Grand Island, Nebraska, its <br />successors and assigns, of the amount of the grant he reinabove <br />referred to or, as the case may be, a part thereof in accordance <br />with the terms and conditions set forth in the HOUSING <br />REHABILITATION GRANT AGREEMENT to which reference is made <br />hereirabove. <br />The lien herein granted shall run with the premises for a <br />period of three (3) years from this date, and shall also bind the <br />successors and assigns and, except as provided in such AGREEMENT, <br />the personal representatives, heirs, deviseees, and legatees of <br />Homeowner. <br />Dated this .'t~ day ofs~L~~u_.~r~, <br />---- <br />/ _ , <br />~ ( . 1. ~, -L,/rrz-~ ~ ,,1~_~~%i2r~L^~ <br />STATE OF NEBRASKA ) <br />County of Hall ) <br />ss <br />On this I~~ ~ day of ~ ?CLa.ec_, before me, the <br />undersigned, duly commissioned a acting in and for such county, <br />personally appeared Walter and Wilma Bernth, husband and wife <br />known to me to be the identical persons whose signatures are <br />affixed to the foregoing instrument, and they acknowledged the <br />execution of such instrument to be their voluntary act (s) and <br />deedsCs}, <br />In witness whereof, I have hereunto set my official hand and <br />seal the date last above written. <br />', '; r <br />6EtKR+~.
