___..... 83-~ s~GO~ Trustee all sums of money due or to become due to it in accordance with the terms and provisions hereof, then upon the final- payment thereof this Indenture and the rights he-reby granted shalt cease, determine and be void; otherwise this Indenture shall remain in full force and effect. THIS INDENTURE FURTHER WITNESSETH, and it is expressly declared, that all Bonds issued and secured hereunder are to be issued, authenticated and delivered and all said groperty, rights and interests, including, without limitation, the Agreement rentals and other amounts hereby assigned and pledged are to be dealt with and disposed of under, upon and subject to the terms, conditions, stipulations, covenants, agreements, trusts, uses and purposes as herein expressed, and Issuer has agreed and covenanted, and does hereby agree and covenant with Trustee and with the respective owners of the Bands as follows: ARTICLE I DEFINITIONS The following words and phrases shall have the following meanings: "Act" means the Nebraska Industrial Development Act, Chapter 18, Article 16, Nebraska Revised Statutes, as amended. "Additional Bonds'i means bonds issued by Issuer pursuant to this Indenture in addition to the Series 1°83 Bonds. "Agreement" means the Lease Agreement dated as of this date, between Issuer and Company, and any amendments and supplements thereto. "Bond Fund" means the fund created ir_ Section 5.02 hereof. "Bonds" means the Series 1983 Bonds and any Additional Bonds. "Bondholder" or "holder" or "owner of the Bonds" means the registered owner of any fully registered Bond. "Business Day" means a day on which banking business is transacted, but not including any day on which banks are authorized to be closed, in the city in which Trustee has its principal corporate trust office. -~-
