<br />WARRANTY DEED
<br />i. The CiCy of Grand Island, Nebraska, by action of its City
<br />Council on September 13, 1982, enacted Ordinance No. 6840 which
<br />directed the conveyance of the real estate described below and the
<br />manner and terms thereof.
<br />2. Ordinance No. 6840 was published in the Grand Island Daily
<br />Zndependent according to law, and notice of such sale and the terms
<br />thereof was published in the C-rand Island Daily Independent for
<br />three consecutive weeks, on September 21, 1982, September 28, 1982,
<br />and October 4, 1982, all as required by Section 16-202, R.R.S. 1943.
<br />3. No remonstrance against such sale was filed with the City
<br />Council of the City of Grand Island, Nebraska, within thirty days
<br />of Che passage and publication of Ordinance No. 6840.
<br />4. Section 5 of Ordinance No. 6840 provides that if no remon-
<br />strance be filed against such com=eyance, the Mayor and City C1erk-
<br />Finance Director shall make, execute, and deliver to O'Neill
<br />Construction Company, a partnership, a warranty deed for said real
<br />estate, and the execution of such deed is hereby authorized without
<br />further action on behalf of the City Council.
<br />N047, THEREFORE, the City of Grand Island, Nebraska, a municipal
<br />corporation in Ha11 County, Nebraska, as Grantor, in consideration
<br />of One Dollar i$1.00) received from Grantee, does hereby grant,
<br />bargain, sell, com~ey, and confirm unto
<br />O'NE~ILL CONSTRUCTION COMPANY,
<br />a partnership, herein called the Grantee, the following described
<br />real property in the Southeast Quarter tSE4) of Section 21, Township
<br />11 North, Range 9 West of the Sixth P.D1., in the City of Grand
<br />Island, Hall County, Nebraska:
<br />Beginning at the Northwest corner of Lot Pive t5)
<br />in O'Neill Second Subdivision and the West line
<br />of vacated Hope Street lying adjacent to Lat
<br />Three i3) of O`Neill Third Subdivision, to the
<br />Southwest corner of the street vacated by
<br />Ordinance No. 5596, this paint being an the
<br />right-af-way line of the cul-de-sac on Hope
<br />Street and having a 50 foot radius; thence South-
<br />west to a point thirty i30) feet West of the last
<br />described course measured perpendicularly and
<br />526.67 feet South of the North line aL the South-
<br />east Quarter tSE'~) of Section 21, Township 11
<br />North, Range 9 West of the 6th P.M.; thence North
<br />48b.67 feet on a line parallel to the West line
<br />of O`Neill Second Subdivision and the West line
<br />of the street vacated by Ordinance Na. 5596, to a
<br />point 40 feet South of the North line of said
<br />Southeast Quarter tSE~) of said Section 21;
<br />thence East parallel to the North line of said
<br />Southeast Quarter (SE 4) of said 5ectian 2i, a
<br />distance of 30 feet to the point of beginning,
<br />all as shown on the plat marked Exhibit "A"
<br />atCached hereto and incorporated herein by refer-
<br />ence.
<br />To have and to hold the above described premises, together with
<br />all tenements, hereditaments and appurtenances thereto belonging
<br />unto the Grantee and to Grantee's heirs, devisees, executors, admin-
<br />istrata~s, successors, and assigns, forever.
