<br />,-;• <br />such reasonable security as may be demanded by Mort~agee to insure payment <br />thereof and to prevent any sale, foreclosure or forfeiture of the premises by <br />reason of such nonpayment, provided such security need not exceed one and <br />one-half times the amount of such lien or claimed lien. On final determination <br />of the lien or claim of lien, the Mortgagor will immediately pay any final <br />judgment rendered with all proper costs and charges and shall have the lien <br />released or judgment satisfied at Mortgagor's own expense. <br />8. To save Mortgagee harmless from all costs and expenses, <br />including reasonable attorneys' fees and costs of a title search, continuation <br />of abstract and preparation of survey incurred by reason of any action, suit, <br />proceeding, hearing, oration or application before any court or administrative <br />body (excepting an action to foreclose or to collect the debt secured hereby) <br />in and to which Mortgagee may be or become a party''by reason hereof, <br />including, but not limited to, condemnation, bankruptcy, probate and <br />administration proceedings, as welt as any other of the foregoing wherein <br />proof of claims is by law required to be filed or in which it becomes <br />necessary to defend or uphold• the terms of the lien created by this Mortgage, <br />and all money paid or expended by Mortgagee in that regard, together with <br />interest thereon from date of such payment at the rate provided for is the <br />Promissory Note shall be so much additional indebtedness securest hereby and <br />shall be immediately and without notice due and payable by Mortgagor. <br />9. That Mortgagor will give Mortgagee immediate notice of the <br />actual or threatened commencement of any proceedings under eminent domain <br />affecting a!I ar any part of the said premises, or any easement therein or <br />appurtenance thereof, including severance and consequential damage and <br />change in grade of streets, and wilt deliver to Mortgagee copies of any and <br />afl papers served in connection with any such proceedings. Mortgagor <br />further covenants and agrees to make, execute and deliver to Mortgagee, at <br />any time or times upon request, free, clear and discharged of any <br />encumbrances of any kind whatsoever, any and all further assignments-and/or <br />instruments deemed necessary by Mortgagee for the purpose of validly and <br />sufficiently assigning aII awards and other compensation heretofore and <br />hereafter to be made to Mortgagor (including the assignment of any award <br />from the United States Government at any time after the allowance of the <br />claim therefor, the ascertainment of the amount thereof and ttie issuance of <br />the warrant for payment thereof) for any taking, either permanent or <br />temporary under any such proceeding. <br />10. That Mortgagor, within five (5) days upon request by mail, <br />wilt furnish a written statement duly acknow{edged of the amount due upon <br />this Mortgage and whether any offsets or defenses exist against the mortgage <br />debt. <br />11. That the Mortgagor and all subsequent owners of the mortgaged <br />premises shall keep and maintain fuU and correct books and records showing in <br />detail the earnings and expenses of said premises and shall permit the Mortgagee <br />or its representatives to examine such books and records and ail supporting <br />vouchers and data at any time and from time to time on request at the offices <br />of Mortgagor, hereinbefare identified; or a* 5„rh other laraYir~nc as may be <br />mutually agreed upon; within ten (10} days after demand therefor, and in any <br />event within ninety (94} days following the expiration of Mortgagor's first fiscal <br />year and following the expiration of each fiscal year thereafter during the term <br />of ibis Mortgage wiN furnish to the Mortgagee a statement showing in detail ail <br />such earnings and expenses since the last such statement verified by the manag- <br />ing partner of Mortgagor and a complete financial statement of Mortgagor's assets <br />and liabilities and a profit and loss statement of Mortgagor, all in form and <br />content satisfactory to Mortgagee; also, if so requested, a rent roil of said <br />premssas with respect to each tenancy; the name of the tenant, the space <br />occupied, the date and term of such lease, the amount of annual rental and <br />additional rental; and in the event that Mortgagor shall refuse or fail to <br />furnish any statement a5 aforesaid, or in the event such statement shall be <br />il18cC1Jf'ate ar false, or in the event of the fai4ure of the Mortgagor ar any <br />_~,. <br />
