Leonard E. Schneider passed away on August 9, 2002 and his Will was probated in <br />the County Court of Adams County, Nebraska, Case No. PR 02-90. <br /> <br />2. Under Paragraph NINTH of the Last Will and Testament of Leonard E. Schneider, <br />Decedent's wife, Betty 1. Schneider, and Affiant, Michael Hoban, were appointed <br />Co- Trustees of the Leonard E. Schneider Testamentary Trust. The real estate <br />described in Exhibit "A" attached hereto and by this reference incorporated herein <br />was distributed by the Personal Representative of the Estate of Leonard E. Schneider <br />to the Co-Trustees of the Leonard E. Schneider Testamentary Trust. <br /> <br />3. Paragraph NINTH (iv) provides, in part, as follows: <br /> <br />"In the event either of my named Trustees is unwilling or unable to act <br />as Co-Trustee, or ceases to act as Co-Trustee, the other named Trustee <br />shall act as sole Trustee." <br /> <br />4. Betty 1. Schneider passed away on October 31, 2008. <br /> <br />5. Affiant, Michael Hoban, represents and acknowledges that he is the sole surviving <br />Co- Trustee of the Leonard E. Schneider Testamentary Trust and he is now the duly <br />appointed and acting Trustee of the Leonard E.
