MAJERUS, husband and wife, hereinafter referred to as "Trustors" whether one or more, <br />whose mailing address is 14030 S 70TH RD, DONIPHAN, Nebraska 68832; and Pathway Bank, a Nebraska Banking <br />Corporation, whosemailingaddressisPOBox428.Cairo. Nebraska, 68824, hereinafter referred to as "Lender". <br /> <br />DEED OF TRUST: Lender and Trustors have entered into a Deed of Trust dated FEBRUARY 12,2008 which has been <br />recorded in HALL County, State of Nebraska as follows: <br /> <br />ENTERED AS INSTRUMENT NO. 0200801356 <br /> <br />REAL PROPERTY DESCRIPTION: The Deed of Trust covers the following described real property located in HALL <br />County, State of Nebraska: <br /> <br />A tract of land comprising part of the Northeast Quarter (NE1I4) of Section Thirty (30), Township Nine (9) North, <br />Range Ten (10), West of the 6th P.M., Hall County, Nebrasl<a, more particularly described as follows: Beginning at <br />the Northeast corner of said Northeast Quarter (NEl/4) of Section Thirty (30); then~e running Southerly along the <br />Easterly line of said Northeast Quarter (NEI/4) a distance of Four Hundred Forty (440) feet; thence running Westerly <br />and parallel to the Northerly line of said Northeast Quarter (NEl/4) a distance of Two Hundred Ninety Seven (297) <br />feet; thence running Northerly and parallel to the Easterly line of said Northeast Quarter (NEl/4) a distance of Four <br />Hundred Forty (440) feet to a point on the Northerly line of said Northeast Quarter (NEl/4); thence running Easterly <br />along the Northerly line of said Northeast Quarter (NE1I4) a distance of Two Hundred Ninety Seven (297) feet to the <br />point of beginning. <br /> <br />Modification, Lender and Trustors hereby modify the Deed of Trust as follows: <br /> <br />INCREASE LOAN AMOUNT TO $125,000.00 <br /> <br />Continuing Validity: Except as expressly modified above, the terms of the original Deed"ofTrust shall remain unchanged <br />and in full force and effect. Consent by Lender to this modification does not waive Lender's right to require strict <br />performance of the Deed of Trust as changed above nor obligate Lender to make any future modifications. Nothing in this <br />Modification shall constitute a satisfaction of the promissory note 01' other credit agreement secw.cd by theDeed of Trust (the <br />"Note"). It is the intention of Lender to retain as liable all parties to the Deed Of Trust and all parties, makers and endorsers <br />to the Note, including accommodation p81ties, unless a party is expressly released by Lender in writing. Any maker or <br />endorser, including accommodation makers,. shall not be released by virtue of this Modification. If any person who signed <br />the original Deed of Trust does not sign this Modification, then all persons signingbelow acknowledge that this Modit1cation <br />is given conditionally, based upon the representation to Lender that the non-signing person consents tothe changes and <br />provisions of this Modification or otherwise will not be released by it. This waiver applies not only to any initial extension or <br />modification, but also to all such subsequent actions. <br /> <br />TRUSTORS ACKNOWLEDGE HAVING READ ALL THE PROVISIONS OF THIS MODIFICATION OF DEED OF <br />TRUST AND TRUSTORS AGREE TO ITS TERMS.
