<br />TRUSTEE'S DEED UPON SALE
<br />
<br />THE STATE BANK OF LEBO, P. O. Box 46, Lebo, Kansas, TRUSTEE,
<br />does hereby grant, transfer and convey, without covenant or
<br />warranty, express or implied, to THE STATE BANK OF LEBO, Lebo,
<br />Kansas, the following described real property:
<br />
<br />LOTS ONE (1) THRU TWENTY NINE (29), BELLAMY'S SECOND
<br />SUBDIVISION, HALL COUNTY, NEBRASKA and Outlot C.
<br />
<br />together with all buildings, improvements, fixtures, accessories
<br />and appurtenances thereto belonging.
<br />
<br />To have and to hold the above-described property unto the
<br />GRANTEE, its successors and assigns.
<br />
<br />This conveyance is made pursuant to the powers conferred upon
<br />the TRUSTEE by a certain Deed of Trust dated April 6, 2007,
<br />executed by JOHN P. BELLAMY and BONNIE S. BELLAMY, husband and
<br />wife, as TRUSTORS, to THE STATE BANK OF LEBO, Lebo, Kansas, as
<br />TRUSTEE, said Deed of Trust was recorded in the Office of the
<br />Register of Deeds, Hall County, Nebraska, on October 2, 2007, as
<br />Document No. 0200708452 to secure payment of one certain
<br />Promissory Note in the original amount of Five Hundred Six
<br />Thousand Seven Hundred Fifty Dollars ($506,750.00) and a further
<br />Promissory Note dated February 16, 2007, in a principal sum of One
<br />Hundred Twenty Five Thousand Dollars ($125,000.00) and pursuant to
<br />a change of terms modifying said loan to increase said amount to
<br />Two Hundred Twenty Five Thousand Dollars ($225,000.00) and
<br />interest as provided thereon.
<br />
<br />Default has occurred under the terms of said Deed of Trust
<br />and the obligations secured thereby, as more particularly set
<br />forth in the Notice of Default recorded in the Office of the
<br />Register of Deeds of Hall County, Nebraska, on May 22, 2008, as
<br />Document No. 0200804452.
<br />
<br />On May 27, 2008, a copy of the Notice of Default, with the
<br />recording data shown thereon, was mailed to the TRUSTORS and all
<br />interested parties by certified mail, return receipt requested,
<br />postage prepaid, to the addresses shown in the Affidavit dated
<br />July 31, 2008.
<br />
<br />After the lapse of not less than two (2) months, THE STATE
<br />BANK OF LEBO, Lebo, Kansas, TRUSTEE, in consequence of the Notice
<br />of Default and in compliance with the terms of the Deed of Trust,
<br />did execute a Notice of Trustee's Sale, stating that the above-
<br />"described real property would-h-e- sold at-public' auction to the
<br />highest bidder for cash on the first floor of the Hall County
<br />Courthouse in the City of Grand Island, Hall County, Nebraska, on
<br />September 15, 2008, at 10:00 o'clock A.M. The Notice of Trustee's
<br />Sale was published in the Grand Island Daily Independent, Grand
<br />Island, Nebraska, a newspaper having general circulation in Hall
<br />County, Nebraska, with the first publication being on August 5,
<br />2008, and thereafter on August 12, 2008, August 19, 2008, August
<br />26, 2008 and September 2, 2008.
<br />
<br />On August 7, 2008, a copy of the Notice of Trustee's Sale was
<br />mailed to the TRUSTQRS and all interested parties by certified
<br />mail, return receipt requested, postage prepaid, to the addresses
<br />shown on the Affidavit of Service dated August 7, 2008.
