The Grantee, its heirs and assigns, shall have the right to use and develop the <br />Easement Property for any lawful purpose including earthmoving, draining, benning, and <br />landscaping as necessary and the locating and operating of Grantee's Livestock Waste Control <br />Facility ("L WCF"). <br /> <br />2. The Grantor and the Grantee agree that the Grantor may continue to use the <br />Easement Property for its existing agricultural use so long as it does not interfere in any way with <br />the Grantee's use and/or proposed use of the Easement Property for its L WCF. <br /> <br />3. The Grantor, its heirs and assigns, shall be responsible for any and all damage <br />resulting from the Grantee's, its heirs and assigns, use of the Easement Property. <br /> <br />4. The Grantor and Grantee agree this Easement shall run with the land and shall be <br />in full force and effect for such time period in which Grantee desires to use the Easement <br />Property for its LWCF. <br /> <br />5.
