<br />OPTION AGREEMENT
<br />
<br />1. This Option Agreement is made between Richard L. Smith and Linda M. Smith,
<br />Husband and Wife, of Grand Island, Nebraska, as Seller, and Warren D. Mathews, as Buyer.
<br />2. In consideration of the sum of Five Thousand and 001100 Dollars ($5,000.00); the
<br />mutual benefits to each party and the money to be paid herein; and other good and valuable
<br />consideration, receipt of which is hereby acknowledged, Seller hereby grants to the Buyer a first
<br />option to purchase the real estate described as :
<br />
<br />A tract ofland comprising a part ofthe Northeast Quarter (NEl/4), Section Fourteen
<br />(14), Township Eleven (11) North, Range Nine (9) Westofthe 6th P.M" Hall County,
<br />Nebraska, more particularly described as follows: Beginning at the Southwest corner
<br />of Lot 33, Sass Second Subdivision to HaH County, Nebraska; thence Southerly
<br />along and upon the West line of said Lot 33 extended, a distance of 295,17 feet;
<br />thence easterly and parallel to the south line of said Sass Second Subdivision, a
<br />distance of 295.17 feet; thence northerly and parallel to the West line of said Lot 33
<br />extended a distance of 295,17 feet to a point on the South line of Sass Second
<br />Subdivision; thence Westerly along and upon the Southerly line of Sass Second
<br />Subdivision a distance of295,17 feet to the point of beginning.
<br />
<br />The above tract of land contains two (2) acres more or less, and includes a house, barn and shed.
<br />3. The purchase price for said real estate shall be the sum of Seventy Five Thousand and
<br />nail 00 Dollars ($75,000.00).
<br />4. Said purchase price shall be paid in cash or certified funds at the time a deed to the
<br />property is delivered to Buyer. .
<br />5. This Option may be exercised anytime from March 3, 2009, through March 15,2009.
<br />The option shall be exercised by delivering written notice ofthe exercise of the option to Seller.
<br />6. At the time the option is exercised, the $5,000.00 option payment shall be applied to
<br />the purchase price. The transaction shall then close by April 30, 2009. In the event that the option
<br />is ne! exercised by midnight on March 15, 2009. for :my reason, or, if the purchase d(leS not close
<br />by April 30,2009, the $5,000.00 shall be retained by the Seller, and this option agreement shall be
<br />null and void.
<br />7. This is the full and complete agreement between Seller and Buyer, and all other
<br />agreements, written at oral, are incorporated herein.
<br />8, This agreement shall be binding upon the heirs, personal representatives, successors
<br />and assigns of the Seller and Buyer,
<br />9. This agreement shall be filed of record with the Hall County Register of Deeds.
