Craig, DIRECTOR, in the name of the STATE OF NEBRASKA and for the <br />DEPARTMENT OF ROADS~QLsaid$tate of Nebraska, under .th_eprovisions QL$_ectiqn39-132~ <br />R.R.S. of Nebraska, 1943 and for and in consideration of the sum of One Dollar and other valuable <br />consideration ($1.00) DOLLARS in hand paid, does hereby grant, bargain, sell, convey, remise, <br />release and forever quitclaim unto State of Nebraska, Nebraska Game and Parks Commission, <br />hereinafter known as the Grantee, whether one or more, the following described real property <br />situated in Hall County and State of Nebraska and subject to any and all existing restrictions and/or <br />easements: <br /> <br />A tract of land located in Lots 5, 6 and 9 and land accreted thereto of Section 20, <br />Township 10 North, Range 9 West of the Sixth Principal Meridian, Hall County, Nebraska, <br />described as follows: <br /> <br />Referring to the point where the South Right of Way Line of 1-80 intersects the West Right <br />of Way Line of abandoned railroad; thence northerly a distance of 358.15 feet along the West Line <br />of said abandoned railroad to the point of beginning; thence northerly deflecting 000 degrees, <br />00 minutes, 00 seconds, a distance of 1722.75 feet along said line to a point on the centerline of <br />Platte River; thence southeasterly deflecting 124 degrees, 31 minutes, 24 seconds right, a distance <br />of 121.37 feet along the centerline of said Platte River to a point of the East Line of said abandoned <br />railroad; thence southerly deflecting 055 degrees, 28 minutes, 36 seconds right, a distance of <br />1632.25 feet along said line to a point on the North Line of said 1-80 right of way; thence westerly <br />deflecting 077 degrees, 45 minutes, 00 seconds right, a distance of 102.33 feet along said right of <br />way line to the point of beginning containing 3.85 acres, more or less. <br /> <br />There will be no ingress or egress between the existing Interstate Highway and the above <br />described tract, the intent being to deny entry to and exit from said highway. <br /> <br />Upon the abandonment or non public use of the above described premises by the Grantee, <br />title shall revert unto the grantor. <br /> <br />In accordance with Article III, Section 20 of the Constitution of the State of Nebraska, the <br />State of Nebraska, Department of Roads does hereby retain and reserve to itself all salt springs, <br />coal, oil, gas, natural resources or other mineral rights it may have in or on the above described <br />real property. <br /> <br />The grantees, for themselves, their heirs, personal representatives, successors in interest, <br />and assigns, as a part of the consideration hereof, does hereby further covenant and agree "as a <br />covenant running with the land" that the land herein conveyed shall not be used for the storage, <br />processing, sorting, transfer or any other use related to or connected with scrap material of any <br />nature or kind; or any other use, which would create or cause an unsightly or obnoxious <br />appearance upon the premises herein conveyed. <br /> <br />The State of Nebraska, Department of Roads, reserves an easement for the operation, <br />maintenance and use of any and all existing utilities which are located over, under or upon the <br />above described tract. In the event that there are no existing utilities located in, on or across the <br />property conveyed herein, this easement will be null and void. <br /> <br />The State reserves to itself a permanent easement over which the various impacts, <br />including but not limited to, noise, air, light, and dust, associated with vehicular traffic on the <br />highway may be disbursed. <br /> <br />Return to : Daryl Behrends <br />Nebraska Dept. of Roads, R.O.W.
