<br />~.' <br /> <br />200808094 <br /> <br />RESOLUTION NO. 08.9.4 <br /> <br />A RESOLUTION DETERMINING BUILDING LOCATED AT 4035 SOUTH ALDA ROAD, <br />ALDA, NEBRASKA TO BE AN UNSAFE BillLDING, DIRECTING NOTIFICATION TO BE <br />GIVEN, AND DIRECTING THE RECORDING OF A COpy OF THIS RESOLUTION IN <br />THE OFFICE OF THE HALL COUNTY REGISTER OF DEEDS TO BE INDEXED OF <br />RECORD AGAINST lHIS REAL ESTATE. <br /> <br />WHEREAS, the Village of Aida has received complaints concerning the condition of that <br />real estate located at 4035 South AIda Road, AIda, Nebraska, legally described as: <br /> <br />Lot Nine (9), of Stevenson's Subdivision, being a part of Lot Five (5) of the <br />County Subdivision ofthe Northwest Quarter (NW1/4) and the West Half ofthe <br />Northeast Quarter (Wl/2NEl/4) of Section Five (5), Township Ten (10) North, <br />Range Ten (10) West of the 6th P.M. in the Village of AI~ Hall County, <br />Nebraska; <br /> <br />WHEREAS, the Hall County Building Inspector has now detennined that the <br />improvements on such real estate should be condemned and has posted such property with notice <br />of such condemnation; <br /> <br />WHEREAS, the Board of Trustees of the Village of AIda, Nebraska, has now determined <br />that the manufactured home located on such real estate constitutes an unsafe building by reason <br />of the definition contained in Aida Municipal Code ~ 9~20 I; <br /> <br />WHEREAS, the Board of Trustees of the Village of AIda, Nebraska, hereby finds and <br />determines that notice should be given to all parties of interest in respect to such real estate as set <br />out in AIda Municipal Code ~ 9-203; and <br /> <br />WHEREAS, Neb.Rev .Stat. ~ 18-1722.01 requires that a copy of this resolution be <br />recorded with the office of the Hall County Register of Deeds, <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY TIffi CHAIRPERSON AND BOARD OF <br />TRUSTEES OF THE VILLAGE OF ALDA, NEBRASKA, THAT: <br /> <br />1. By reason of condemnation by the Hall County Building Inspector of the <br />manufactured home located at 4035 South AIda Road, AIda, Nebraska, the Board of Trustees of <br />the Village of AIda, Nebraska determines that such manufactured home is currently unoccupied <br />and constitutes a nuisance as an unsafe building which is dangerous to the public health due to <br />failure to secure the premises from entrance by people, animals and the elements and because of <br />such lack of proper repair constitutes a fire and safety hazard. <br /> <br />2. The Village Attorney is further hereby directed to give notice to all parties having an <br />interest of record in respect to such real estate consistent with the requirements of AIda <br />Municipal Code ~ 9-203. <br /> <br />3. In the event that the owner or other parties of interest in respect to such real estate <br />shall fail to remedy the unsafe condition of the described building or demolish it within sixty <br />(60) days following the date of the receipt of such notice from the Village Attorney, the Village <br />
