<br /> <br />THAT Michael F. Kivett, Attorney at Law duly licensed to practice in the State of Nebraska, <br />Trustee, in the exercise of the power of sale conferred upon him, does hereby execute and deliver this <br />indenture, <br /> <br />WITNESSETH THAT: <br /> <br />WHEREAS, for a valuable consideration on February 28, 2007, Jason C. Cornelius and Stacy <br />Cornelius, husband and wife, Trustors, executed and delivered their Deed of Trust to Ticor Title <br />Insurance Company, as Trustee, and Mortgage Electronic Registration Systems, Inc., solely as nominee <br />for Decision One Mortgage Company, LLC, as Beneficiary, conveying the real estate hereinafter <br />described in trust, with power of sale, in accordance with the terms and provisions set forth therein; that <br />said Deed of Trust was thereafter recorded on March 2, 2007 in the office of the Register of Deeds of <br />Hall County, Nebraska as Instrument No. 0200701630; that all beneficial interest under said Deed of <br />Trust was subsequently and duly assigned to CitiMortgage, Inc., which Assignment is dated June 13, <br />2008 and recorded on June 23, 2008 as Instrument No. 0200805407 in the office of the Register of Deeds <br />of Hall County, Nebraska; and <br /> <br />WHEREAS, that on June 26, 2008, CitiMortgage, Inc., Beneficiary upon the aforementioned <br />Deed of Trust, appointed Michael F. Kivett, Attorney at Law, as Successor Trustee, which Substitution <br />of Trustee was recorded July 2, 2008, as Instrument No. 0200805699, in the Register of Deeds of Hall <br />County, Nebraska. A copy of said Substitution of Trustee was served upon the prior Trustee, Ticor Title <br />Insurance Company, on or about June 30, 2008; and <br /> <br />WHEREAS, the Trustors having defaulted in the payment of the indebtedness secured thereby <br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited <br />with the Trustee all promissory notes; and <br /> <br />WHEREAS, in compliance with Sec. 76-1006, Statutes of Nebraska, on July 2, 2008, the Trustee <br />filed a Notice of Default in the office of the Register of Deeds of Hall County, Nebraska, as Instrument <br />No. 0200805700, which Notice fully complied with the requirements of said statute; and <br /> <br />WHEREAS, in compliance with Sec. 76-1008, Statutes of Nebraska, on July 7,2008, the Trustee <br />mailed by certified mail, with postage prepaid, a copy of such Notice of Default with the recording date <br />shown thereon, addressed to the following interested parties, to-wit: <br />
