Depue, Attorney at Law, and states that: <br /> <br />1. He is the Trustee under the Deed of Trust recorded in the <br />office of the Hall County Register of Deeds as Instrument No. <br />200509745, on September 30, 2005. <br /> <br />2. That Ziska Properties, LLC, is the Trustor under said <br />Deed of Trust. <br /> <br />3. That certain real property was conveyed to Bank of Clarks <br />as Trustee under the aforementioned Deed of Trust as security on a <br />note payable to Bank of Clarks. <br /> <br />4. The legal description of the said real property is as set <br />forth on Exhibit A attached hereto. <br /> <br />A breach of an obligation secured by the Trust property has <br />occurred and the Beneficiary and Trustee have elected to sell or <br />cause to be sold the trust property to satisfy the obligation, to- <br />wit: failure to pay note installments. <br /> <br />After the lapse of not less than one month, if the default has <br />not been cured, the Trustee is entitled to give Notice of Sale <br />according to law. <br /> <br />This Notice of Default is being recorded in the office of the <br />Register of Deeds as provided by law. <br /> <br /> <br />~}U 2008 <br /> <br />RONALD S.
