<br />200807402 <br /> <br />formation of the Association, unless such indebtedness has been retired by all of the <br />Unit Owners. <br /> <br />b. One Year. No action to challenge the validity of an amendment adopted by the <br />Association pursuant to this Section may be brought more than one (1) year after the <br />amendment is recorded. <br /> <br />c. Recordation. Every amendment to the Declaration must be recorded in the office of <br />the Register of Deeds of Hall County, and is effective only upon recordation. <br /> <br />d. Amendments. Amendments to the Declaration required by the Act to be recorded by <br />the Association shall be prepared, executed, recorded, and certified on behalf of the <br />Association by the President and Secretary or Treasurer of the Association. <br /> <br />36. Termination. <br /> <br />a. Except in the case of a complete taking of all the Units of the Condominium by <br />eminent domain, the Condominium may be terminated only by agreement of the Unit <br />Owners owning at least ninety percent (90%) of the Allocated Interests. <br /> <br />b. An agreement to terminate must be evidenced by the execution of a termination <br />agreement, or ratifications thereof, in the same manner as a deed, by Unit Owners <br />owning at least ninety percent (90%) of the Allocated Interests. Said termination <br />agreement must specify a date after which the agreement will be void unless <br />recorded before that date. The termination agreement and all ratification thereof is <br />effective only upon recordation in the office of the Register of Deeds of Hall County. <br />The Act shall govern any termination. <br /> <br />37. General. <br /> <br />a. If any of the provisions of the Condominium Documents or any section, sentence, <br />clause, phrase, or word, or the application thereof in any circumstances shall be <br />invalidated, such invalidity shall not affect the validity of the remainder of the <br />Condominium Documents, and the application of any such provision, section, <br />sentence, clause, phrase, or word in any other circumstance shall not be affected <br />thereby. <br /> <br />b. The provisions of the Condominium Documents shall be in addition and <br />supplemental to the Act and to all other provisions of applicable law, and the <br />provisions of such Act shall apply in the event of conflict with, or omission from, the <br />Condominium Documents of provisions required by the Act. <br /> <br />c. In the event there shall be any conflict between the provisions of this Declaration and <br />the Articles, Bylaws or Rules and Regulations, the provisions of this Declaration <br />shall be controlling. <br /> <br />-18- <br />
