<br />WHEREAS, Diane G. Meyer, Successor Trustee of the Testamentary Trust created under
<br />the Last Will and Testament of John D. Moss, deceased, dated December 27, 1983, hereinafter
<br />referred to as "Diane (. Meyer, Trustee" is the owner of record of the following described real
<br />estate, hereinafter referred to as "Tract I ", to -wit: 11�
<br />The North Half of the Southwest Quarter (N' /2SW' /a) of Section Seven (7),
<br />Township Ten (10) North, Range Eleven (11) West of the 6th P.M.,
<br />Hall County, Nebraska;
<br />and
<br />WHEREAS, Allan E. Miller and Joyce E. Miller, husband and wife, hereinafter referred
<br />to as "Millers" have agreed to purchase the following described real estate, hereinafter referred to
<br />as "Tract 2 ", to -wit:
<br />The South Half of the Southwest Quarter (S' /2SW1 /4) of Section Seven (7),
<br />Township Ten (10) North, Range Eleven (11) West of the 6th P.M. in
<br />Hall County, Nebraska, less the westerly 50 feet thereof conveyed to the
<br />State of Nebraska for highway right -of-way and excepting therefrom that
<br />approximately 6.7 acre parcel now known as Lot I Miller Subdivision
<br />previously conveyed to Millers by Warranty Deed recorded in the Office
<br />of the Hall County Register of Deeds as Document No. 83- 003064;
<br />and
<br />WHEREAS, Tract 2 is located directly adjacent to the South of Tract 1 and in order for
<br />Millers to have access to the crop land area situated on Tract 2 located North and East of the
<br />slough area identified on the attached Exhibit "A ", Millers need an easement for ingress and
<br />egress over, through and upon the existing roadway area situated upon Tract I from Highway I 1
<br />located West of Tract I and Tract 2 to the aforesaid crop land area.
<br />NOW, THEREFORE, for valuable consideration, the receipt and adequacy of which is
<br />hereby acknowledged, Diane G. Meyer, Trustee hereby grants until Millers and to Millers'
<br />invitees, agents and employees a non- exclusive perpetual easement for ingress and egress over,
<br />through and upon the existing roadway situated on Tract 1 from Highway I 1 located to the West
