<br />TRUSTEE'S DEED

<br />KNOW ALL MEN BY THESE PRESENTS that GREGORY L. GALLES, is the
<br />Successor Trustee under a Deed of Trust made and entered into on or about May 27,2005, by and
<br />between TARA L. PHELAN and JOSEPH A. PHELAN, wife and husband, Trustors, and
<br />COMMERCIAL FEDERAL BANK, A FEDERAL SAVINGS BANK, Trustee, HOME
<br />FEDERAL SAVINGS AND LOAN ASSN. OF GRAND ISLAND, Beneficiary. Said Deed of
<br />Trust was recorded on May 31,2005 as Instrument No. 2005-04866 of the Mortgage Records of Hall
<br />County, Nebraska. Said Deed of Trust having been assigned by virtue of an Assignment dated May
<br />27,2005 to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., and which was
<br />filed for record on June 23, 2005 as Instrument No. 2005-05663 and subsequently assigned to U.S.
<br />BANK, N.A. by an assignment dated April 4, 2008 and filed for record on April 10, 2008, as
<br />Instrument No. 2008-02998, of the Mortgage Records of Hall County, Nebraska. GREGORY L.
<br />GALLES was appointed Successor Trustee by virtue of a Substitution of Trustee dated April 30,
<br />2008, and recorded May 12, 2008, as Instrument No. 2008-04070 in the Office ofthe Register of
<br />Deeds for Hall County, Nebraska. GREGORY L. GALLES, Grantor, in consideration of the sum
<br />of Eighty-Five Thousand Three Hundred Seventy-Seven and 58/1 00 Dollars ($85,377.58) and other
<br />good and valuable consideration received from U.S. BANK, N.A., does hereby grant, bargain, sell,
<br />convey and confirm unto U.S. BANK, N.A., (hereinafter "Grantee" where appropriate), the
<br />following-described real property in Hall County, Nebraska, to wit:

<br />Lot Four (4), Block Thirteen (13), Wallich's Addition, City of Grand Island, Hall
<br />County, Nebraska.

<br />to have and to hold the above-described premises together with all tenements, hereditaments and

<br />1. That TARA L. PHELAN and JOSEPH A. PHELAN, as Trustors, failed to pay to
<br />Beneficiary payments which were contractually due, and the Grantor, at the request of the
<br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest
<br />thereon at once immediately due and payable.
<br />
<br />2. That a Notice of Default as required by S 76-1006 was filed by Grantor on May 12, 2008, as
<br />Instrument No. 2008-04071 in the Office of the Register of Deeds of Hall County, Nebraska.
<br />A copy of said Notice of Default was thereafter mailed to all parties entitled to notice,
<br />pursuant to said Deed of Trust and in compliance with S 76-1008, RR.S. Nebraska.
<br />
<br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing ofthe Notice of Default.
<br />
<br />4. That a Notice of Trustee's Sale was filed by Grantor onlune 16,2008, as Instrument No.
<br />2008-05172 in the Office of the Register of Deeds of Hall County, Nebraska. A copy of said
<br />Notice of the time and place of the sale was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with S 76-1008, RRS. Nebraska.
<br />
<br />5. That Grantor as required by S 76-1007 published a Notice of Trustee's Sale to be held on July
<br />30, 2008, at 10:00 a.m. in the lower lobby of the Hall County Courthouse, 111 West First
<br />Street, Grand Island, Nebraska. Said Notice was published in Grand Island Independent, a
<br />legal newspaper of Hall County, Nebraska, once a week for five consecutive weeks
<br />commencing on June 17,2008, and ending July 15, 2008. The last publication notice was at
<br />least ten days prior to the Trus~ee'~ Sale hel~ on July 30, 2008, and said sale was no~ater ,
