<br />NOTICE OF SUIT
<br />NOTICE IS HEREBY GIVEN that on the I ~'P+ day of August, 2008, CitiMortgage, Inc., as the
<br />plaintiff, filed its Complaint in the District Court of Hall County, Nebraska, against Michael E. Eatherton
<br />and Kelly 1. Eatherton, husband and wife, as the defendants, the object and prayer of such Complaint
<br />being to obtain an accounting, to foreclose a deed of trust given by said Michael E. Eatherton and Kelly 1.
<br />Eatherton, husband and wife, executed and delivered to First American Title Company, Trustee for the
<br />benefit of Mortgage Electronic Registration Systems, Inc., acting solely as Nominee for CitiMortgage,
<br />Inc., Beneficiary, to foreclose any interest in or lien upon the real estate hereinafter described of the
<br />above-named defendants, to obtain an order for the sale of the real estate hereinafter described for the
<br />satisfaction of the indebtedness secured by such deed of trust and to obtain other equitable relief; that
<br />such deed of trust is dated November 26, 2007 and was recorded on November 26, 2007, as Instrument
<br />number 200709967 in the Office of the Register of Deeds of Hall County, Nebraska, and conveyed to
<br />such beneficiary the following described real estate situated in Hall County, Nebraska, to-wit:

<br />Lot Five (5) in Tara Leigh Subdivision to the City of Grand Island, Hall County,
<br />Nebraska;

<br />and that such deed of trust was sold, transferred, and assigned to the plaintiff by written assignment recorded
