<br />AFFIDAVIT OF DEATH OF LIFE TENANTS

<br />RE: The Southwest Quarter of Section 14, Township 9 North, Range 12
<br />West of the 6th P.M., Hall County, Nebraska.

<br />Charles Schmidt, being first duly sworn on his oath, deposes and says as
<br />follows:
<br />1. He is the Personal Representative of the Estate of Arthur L. Schmidt, whose
<br />estate proceedings are pending in the County Court of Merrick County, Nebraska.
<br />Further, he states that he is the son of Rudolph C. Schmidt, deceased and the nephew
<br />of Arthur L. Schmidt; Raymond C. Schmidt; and Herbert P. Schmidt, all of whom are
<br />deceased.
<br />2. The undersigned knows of his own knowledge that Rudolph C. Schmidt,
<br />Raymond C. Schmidt, Herbert P. Schmidt and Arthur L. Schmidt, each possessed a life
<br />estate in the above referenced real estate through the Last Will and Testament of their
<br />mother, Martha M. Schmidt, who died October 13, 1973, Estate No. 8876, Docket 33,
<br />Page 14, in the County Court of Hall County, Nebraska.
<br />3. Arthur L. Schmidt was the last of the four Schmidt brothers to die on June 17,
<br />2005 and pursuant to the Last Will and Testament of Martha M. Schmidt, title to the
<br />above described real estate became vested in the surviving issue of Rudolph C.
<br />Schmidt, Raymond C. Schmidt, Herbert P. Schmidt and Arthur L. Schmidt in equal
