<br />200806505 <br /> <br />Section 8.3. AssilZIUllent of Rents. Notwithstanding provisions hereof relating to the <br />assigrunent of rents, Administrative Agent shall not exercise its right to receive such rents until it has <br />taken possession, to the extent such possession is required by applicable law to exercise such right. <br /> <br />Section 8.4. Certain Insurance Disclosures. Pursuant to the Illinois Collateral Protection <br />Act and the Illinois Financial Institution Insurance Sales Law, Administrative Agent hereby notifies <br />Mortgagor as follows: You may obtain insurance required in connection with your loan or extension of <br />credit from any insurance agent, broker, or firm that sells such insurance, provided the insurance <br />requirements in connection with your loan are otherwise complied with. Your choice of insurance <br />provider will not affect our credit decision or your credit terms. Unless you provide us with evidence of <br />the insurance coverage required by your agreements with us, we may purchase insurance at your expense <br />to protect our interest in your collateral. This insurance may, but need not, protect your interests. The <br />coverage that we purchase may not pay any claim that you make or any claim that is made against you in <br />connection with the collateral. You may later cancel any insurance purchased by us, but only after <br />providing us with evidence that you have obtained insurance as required by our agreements. Ifwe <br />purchase insurance for the collateral, you will be responsible for the costs of that insurance, including <br />interest and any other charges we may impose in connection with the placement of the insurance, until the <br />effective date of the cancellation or expiration of the insurance. The costs of the insurance may be added <br />to your total outstanding balance or obligation. The costs of the insurance may be more than the cost of <br />insurance you may be able to obtain on your own. <br /> <br />Section 8.5. Business Purposes. Mortgagor certifies, represents and warrants to the <br />Administrative Agent that the indebtedness secured by this Mortgage is a "business purpose loan" as <br />provided in 815 ILCS 4/1 (c). <br /> <br />ARTICLE IX. <br /> <br />Special Washington Provisions <br /> <br />Section 9.1. Property Use. Mortgagor warrants and covenants that the Property is not used <br />principally for agricultural purposes and that the indebtedness secured by this Mortgage was not made <br />primarily for personal, family, or household purposes. <br /> <br />Section 9.2. Deficiencv Judgment. To the extent permitted by applicable law, Trustee or <br />Administrative Agent may obtain a deficiency judgment if the net sales proceeds of any sale of the <br />Property under the power of sale granted by this Mortgage are insufficient to pay in full all of the <br />obligations secured hereby. <br /> <br />Section 9.3. Oral Agreements. ORAL AGREEMENTS OR ORAL COMMITMENTS TO <br />LEND MONEY, EXTEND CREDIT, OR FORBEAR FROM ENFORCING REPAYMENT OF <br />A DEBT ARE NOT ENFORCEABLE UNDER WASHINGTON LAW. <br /> <br />ARTICLE X. <br /> <br />Soecial Vinzinia Provisions <br /> <br />Section 10.1.
