Bartek and Karen <br />K. Farber, each party hereby grants to the other the first right to purchase upon the <br />death of either of them the following described real estate: <br /> <br />The Southwest Quarter (SW1/4) of Section Twenty Two (22), <br />Township Nine (9) North, Range Nine (9), West of the 6th <br />P.M., Hall County, Nebraska, except a tract of land more <br />particularly described as England Subdivision recorded as <br />Document No. 200504031 <br /> <br />pursuant to the terms and conditions contained in the Option to Purchase Real <br /> <br />Property. The first right to purchase shall remain in full force and effect unless: <br /> <br />1. It is exercised in writing by either party upon the death of the other pursuant <br /> <br />to the terms of the option agreement; or <br /> <br />2. Either party upon the death of the other fails to exercise the option to <br /> <br />purchase pursuant to the terms of the option to purchase real estate; or <br /> <br />3. It is waived in writing by either party either before or after the death of one of <br /> <br />the parties; or <br /> <br />4.
