Patterson, <br />Springfield, Missouri 65802, as grantor (hereinafter referred to as "Grantor"), in favor of Fidelity <br />National Title Insurance Company, a California corporation, as Trustee, whose address is 22 Century <br />Blvd., Suite 200 Three Lakeview Place, Nashville, Tennessee 37214, for the use and benefit of BANK <br />OF AMERICA, N.A" a national banking association having an office at 100 Federal Street, 9th Floor, <br />Boston, Massachusetts 02110, as collateral agent for the ratable benefit of the "Credit Parties" as defined <br />in the Credit Agreement (as defined herein) (in such capacity, the "Collateral Agent"), as beneficiary <br />herein (hereinafter in such capacity referred to as "Beneficiary"). <br /> <br />Each capitalized term used herein but not defined herein shall have the meaning assigned to such <br />term in the Credit Agreement (as defined herein). <br /> <br />WIT N E SSE T H: <br /> <br />A.
