ZISKA dated August 30, 2005, and recorded <br />August 30, 2005, as Document No. 200508549 in the Office of the <br />Register of Deeds of Hall County, Nebraska; said Deed of Trust <br />securing the following property: <br /> <br />LOT SEVENTY FOUR (74) HAWTHORNE PLACE, AN ADDITION TO <br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA <br /> <br />EASTERLY ONE HALF (E 1/2) OF LOT SIX (6), BLOCK ONE <br />HUNDRED FORTY ONE (141) IN UNION PACIFIC RAILWAY <br />COMPANY'S SECOND ADDITION TO THE CITY OF GRAND ISLAND, <br />HALL COUNTY, NEBRASKA <br /> <br />said Deed of Trust being in favor of Five Points Bank, a Nebraska <br />Banking Corporation, Trustee and Beneficiary under said Deed of <br />Trust. <br /> <br />Said default under the terms of said Deed of Trust has <br />occurred by virtue of nonpayment of the payments as they became <br />due and payable under a Promissory Note dated August 30, 2005, <br />with a total principal balance due and owing as of June 24, 2008, <br />of FORTY THOUSAND SEVEN HUNDRED NINETY FIVE DOLLARS and FIFTY FOUR <br />CENTS ($40,795.54), unpaid interest of SIX HUNDRED THREE DOLLARS <br />and FORTY THREE CENTS ($603.43) and late charges of ONE HUNDRED <br />FORTY EIGHT DOLLARS and FIFTY CENTS ($148.50), for a total payoff <br />of FORTY ONE THOUSAND FIVE HUNDRED FORTY SEVEN DOLLARS and FORTY <br />SEVEN CENTS ($41,547.47), and per diem interest accruing at the <br />rate of $8.49 from and after June 24, 2008. <br /> <br />In addition, Trustors are hereby liable to Trustee, Five <br />Points Bank, for all fees and costs associated with this default <br />and recovery pursuant to Nebraska Statute ~76-1012. <br /> <br />By virtue of said default, Trustee, Five Points Bank, has <br />determined to sell or cause to be sold the trust property to <br />satisfy the obligations referred to above. <br /> <br />The default may be cured within Thirty (30) days of the <br />filing of this Notice, and the obligations of the Deed of Trust <br />may be thereby reinstated as provided in Nebraska Statute ~76- <br />1012. <br /> <br />DATED: July '1--' 2008. <br /> <br />FIVE POINTS BANK, <br />a Nebraska Banking Corporation <br /> <br />
