<br />KNOW ALL MEN BY THESE PRESENTS that GREGORY L. GALLES, is the Successor
<br />Trustee under a Deed of Trust made and entered into on or about August 23,2005, by and between
<br />ANTHONY Q. MARTINEZ and KERRY R. RESSLER-MARTINEZ, husband and wife, Trustors,
<br />and TICOR TITLE INSURANCE COMPANY, Trustee, MORTGAGE ELECTRONIC
<br />REGISTRATION SYSTEMS, INC. as Nominee for Popular Financial Services, LLC, Beneficiary.
<br />Said Deed of Trust was recorded on August 29, 2005 as Instrument No. 2005-08484 of the Mortgage
<br />Records of Hall County, Nebraska. Said Deed of Trust having been assigned by virtue of an Assignment
<br />dated January 16, 2008 to THE BANK OF NEW YORK AS TRUSTEE FOR EQUITY ONE ABS,
<br />INC. MORTGAGE PASS THROUGH CERTIFICATE SERIES #2005-C, and which was filed for
<br />record on February 8, 2008 as Instrument No. 2008-00993 of the Mortgage Records of Hall County,
<br />Nebraska. GREGORY L. GALLES was appointed Successor Trustee by virtue of a Substitution of
<br />Trustee dated February 7, 2008, and recorded March 24,2008, as Instrument No. 2008-02432 in the
<br />Office of the Register of Deeds for Hall County, Nebraska. GREGORY L. GALLES, Grantor, in
<br />consideration of the sum of Sixty One Thousand Two Hundred Thirteen and 00/100 Dollars ($61,213 .00)
<br />and other good and valuable consideratioh received from THE BANK OF NEW YORK AS TRUSTEE
<br />FOR EQUITY ONE ABS, INC. MORTGAGE PASS THROUGH CERTIFICATE SERIES #2005-
<br />C, does hereby grant, bargain, sell, convey and confirm unto THE BANK OF NEW YORK AS
<br />TRUSTEE FOR EQUITY ONE ABS, INC. MORTGAGE PASS THROUGH CERTIFICATE
<br />SERIES #2005-C, (hereinafter "Grantee" where appropriate), the following-described real property in
<br />Hall County, Nebraska, to wit:

<br />Lot Fourteen (14), Block E, Park View Subdivision, in the City of
<br />Grand Island, Hall County, Nebraska.
<br />
<br />to have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />
<br />1. That ANTHONY Q. MARTINEZ and KERRY R. RESSLER-MARTINEZ, as Trustors failed to
<br />pay to Beneficiary payments which were contractually due, and the Grantor, at the request of the
<br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest thereon
<br />at once immediately due and payable.

<br />2. That a Notice of Default as required by S 76-1006 was filed by Grantor on March 24,2008, as
<br />Instrument No. 2008-02433 in the Office ofthe Register of Deeds of Hall County, Nebraska. A
<br />copy of said Notice of Default was thereafter mailed to all parties entitled to notice, pursuant to
<br />said Deed of Trust and in compliance with S 76-1008, R.R.S. Nebraska.
<br />
<br />3. That the Trustors failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />
<br />4. That a Notice of Trustee's Sale was tiled by Grantor on May 2,2008, as Instrument No. 2008-
<br />03726 in the Office of the Register of Deeds of Hall County, Nebraska. A copy of said Notice of
<br />the time and place of the sale was thereafter mailed to all parties entitled to notice pursuant to said
<br />Deed of Trust and in compliance with S 76-1008, R.R.S. Nebraska.
<br />
<br />5. That Grantor as required by S 76-1007 published a Notice of Trustee's Sale to be held on June 24,
<br />2008, at 10:00 a.m. in the lower lobby of the Hall County Courthouse, 111 West First Street,
<br />Grand Island, Nebraska. Said Notice was published in The Grand Island Independent, a legal
<br />newspaper of Hall County, Nebraska, once a week for five consecutive weeks commencing on
<br />May 2, 2008, and ending May 30, 2008. The last publication notice was at least ten days prior to
<br />the Trustee's Sale held on June 24, 2008, and said sale was not later than 30 days after the last
