METTENBRINK and PATRICIA A. <br />METTENBRINK, Husband and Wife; ARLENE O. METTENBRINK, a single person; <br />GARY R. METTENBRINK and KIM METTENBRINK, Husband and Wife; LYNN <br />WILLIAM MET TENBRINK, a single person; CAROL A. HEIDE formerly CAROL A. <br />METTENBRlNK and BRUCE C. HEIDE, Wife and Husband; FOUR-M LTD, a Limited <br />Partnership, all hereinafter collectively referred to as Grantors, for and in consideration of <br />the sum of Twenty One Thousand Six Hundred Dollars ($21,600.00), lawful of the " <br />United States of America, to them: hi hand paid by the Granteeithe receipt whereof is <br />hereby acknowledged, do by these presence grant, bargain; sell, and convey and confirm <br />unto the City of Wood River, Nebraska, a Municipal Corporation, Grantee, its successors <br />and assigns a right-of~way over and across that certain strip of land as more particularly <br />described on attached Exhibits ,"A" and "B", incorporated herein by reference in Hall <br />County, Nebraska, for the plU-pose of constmcting, maintaining and operating thereon and <br />there over, electric power, transmission and telephone lines, and for use for said <br />purposes, and for the purpose of doing any and all matters and things that are legal and <br />lawful that may be necessary or desirable in connection with the erection, maintenance, <br />construction or operation of said lines. Grantee warrants that after the initial <br />construction'and installation ofthe transmission line pursuant to ,plan disclosed to <br />Grantor, Grantee will not ereCtor install any additional improvements in the easement <br /> <br />area. <br /> <br />The Grantee by accepting and recording of public record the above and foregoing <br />easement does hereby agree with the Grantors, their successors and assigns that any <br />damage caused to planted or growing crops within the easement area by the Grantee its <br />agents or contractors will be reimbursed to Grantors of their successors and assigns for <br />the fair and reasonable value of said damage or destroyed crop. <br />The Grantors, their successors and assigns reserve the right and privilege of <br />entering into and upon the described premises preparing the same for cultivation and all <br />other farming purposes, and the right to use the surface of said premises for farming <br />purposes, without in any manner interfering with the use of said premises by the Grantee <br />and the maintenance and operation of said power transmission line. <br />Grantor and Grantee have entered into a separate written "Operating Agreement" <br />defining their respective rights, duties and obligations in connection with the use and <br /> <br />o <br />N <br />o <br />o <br />co <br />o <br />U1 <br />.....c: <br />-..] <br />...c <br /> <br />m <br />~ <br />:D <br />l!J <br />5) <br />z <br />~ <br />:D <br />c: <br />:s:: <br />~ <br />a <br /> <br />v~ <br /> <br />o <br />t::J <br />
