'.: V) ~ c...... c.= Z N en ~ ::3 N I--" 0') (f) u} GRANT OF EASEMENT FOR ELECTRIC POWER AND TRANSMISSION LINE The undersigned Grantors, DONALD L. ROHRICH and INEZ M. ROHRICH, Husband and Wife, for and in consideration of the sum of FOUR THOUSAND FIFTY Dollars ($4,050.00), lawful of the United States of America, to them in hand paid by the Grantee, the receipt whereof is hereby acknowledged, do by these presence grant, bargain, sell, and convey and confirm unto the City of Wood River, Nebraska, a Municipal Corporation, Grantee, its successors and assigns a right-of-way over and across that certain strip ofland as more particularly described on attached Exhibit "A" incorporated herein by reference in Hall County, Nebraska, for the purpose of constructing, maintaining and operating thereon and there over, electric power, transmission and telephone lines, and for use for said purposes, and for the purpose of doing any and all matters and things that are legal and lawful that may be necessary or desirable in connection with the erection, maintenance, construction or operation of said lines. Grantee warrants that after the initial construction and installation of the transmission line pursuant to plan disclosed to Grantor, Grantee will not erect or install any additional improvements in the easement area. The Grantee by accepting and recording of public record the above and foregoing easement does hereby agree with the Grantors, their successors and assigns that any damage caused to planted or growing crops within the easement area by the Grantee its agents or contractors will be reimbursed to Grantors of their successors and assigns for the fair and reasonable value of said damage or destroyed crop. The Grantors, their successors and assigns reserve the right and privilege of entering into and upon the described premises preparing the same for cultivation and all other farming purposes, and the right to use the surface of said premises for farming purposes, without in any manner interfering with the use of said premises by the Grantee and the maintenance and operation of said power transmission line. Grantor and Grantee have entered into a separate written "Operating Agreement" defining their respective rights, duties and obligations in connection with the use and occupation of the easement area; a copy of the "Operating Agreement" will be kept on file at all times at the office of the Wood River City Clerk and the terms and conditions of said "Operating Agreement" shall be enforceable against each of the parties hereto, their successors and assigns as if set forth in its entirety in this document.
