HEINRICH, a single person and JOYCE M. <br />WIbLOUGHBY,'Trustee o-fthe Residuary Trust created by the terms of the Last Will <br />and Testament of Calvin F. Heinrich, Deceased, for and in consideration of the sum of <br />FIVE THOUSAND FOUR HUNDRED Dollars ($5,400.00), lawful of the United States <br />of America, to her in hand paid by the Grantee, the receipt whereof is hereby <br />acknowledged, do by these presence grant, bargain, sell, and convey and confirm unto the <br />City of Wood River, Nebraska, a Municipal Corporation, Grantee, its successors and <br />assigns a right-of-way over and across that certain strip of land as more particularly <br />described on attached Exhibit "A" incorporated herein by reference in Hall County, <br />Nebraska, for the purpose of constructing, maintaining and operating thereon and there <br />over, electric power, transmission and telephone lines, and for use for said purposes, and <br />for the purpose of doing any and all matters and things that are legal and lawful that may <br />be necessary or desirable in connection with the erection, maintenance, construction or <br />operation of said lines. Grantee warrants that after the initial construction and <br />installation ofthe transmission line pursuant to plan disclosed to Grantor, Grantee will <br />not erect or install any additional improvements in the easement area. <br />The Grantee by accepting and recording of public record the above and foregoing <br />easement does hereby agree with the Grantor, her successors and assigns that any damage <br />caused to planted or growing crops within the easement area by the Grantee its agents or <br />contractors will be reimbursed to Grantor or her successors and assigns for the fair and <br />reasonable value of said damage or destroyed crop. <br />The Grantor, her successors and assigns reserve the right and privilege of entering <br />into and upon the described premises preparing the same for cultivation and all other <br />farming purposes, and the right to use the surface of said premises for farming purposes, <br />without in any manner interfering with the use of said premises by the Grantee and the <br />maintenance and operation of said power transmission line. <br />Grantor and Grantee have entered into a separate written "Operating Agreement" <br />defining their respective rights, duties and obligations in connection with the use and <br />occupation of the easement area; a copy of the "Operating Agreement" will be kept on <br />file at all times at the office of the Wood River City Clerk and the terms and conditions of <br />said "Operating Agreement" shall be enforceable against each ofthe parties hereto, their <br />successors and assigns as if set forth in its entirety in this document. <br />IN WITNESS WHEREOF, the Grantor has caused this easement to be executed <br />the b day of 04-~ ' 2007. <br /> <br />m <br />~ <br />:0 <br />om <br />CJ <br />N:r> <br />oen <br />om <br />co:rJ <br />oC: <br />s: <br />en m <br />...c ~ <br />-.J 6 <br />o <br /> <br />~ <br />~ <br />
