II , 2008, between Richard M. II B> <br />Nyce, Trustee of the Merlon D. Nyce Testamentary Trust, Kipp L. Pfeiffer, a single person, and <br />Midwest Farming Properties I, LLC, a Nebraska Limited Liability Company. <br /> <br />Whereas Richard M. Nyce, Trustee, is the owner ofthe Northwest Quarter (NW/4) of Section <br />Twenty-seven (27), Township Nine (9) North, Range Nine (9) West of the 6th P.M., Hall County, <br />Nebraska (hereinafter the "Property"); and <br /> <br />Whereas Kipp L. Pfeiffer, is the contract purchaser of Lot 1, Nyce Subdivision of the <br />Northwest Quarter (NW/4) of Section Twenty-seven (27), Township Nine (9) North, Range Nine (9) <br />West of the 6th P.M., Hall County, Nebraska (hereinafter the "Residence Property"); and <br /> <br />Whereas Midwest Farming Properties I, LLC, is the contract purchaser of the Northwest <br />Quarter (NW/4) of Section Twenty-seven (27), Township Nine (9) North, Range Nine (9) West of <br />the 6th P.M., Hall County, Nebraska, except Lot 1, Nyce Subdivision, (hereinafter the "Farm <br />Property"); and <br /> <br />Whereas the Parties desire to establish the easement hereinafter set out as a benefit to the <br />present and all future owners ofthe Farm Property and a burden upon the present and all future <br />owners of the Residence Property. <br /> <br />Now therefore it is agreed between the Parties as follows: <br /> <br />1. Access Easement. The present and future owner of the Residence Property hereby grants to <br />the present and future owner ofthe Farm Property an easement across the Residence Property <br />for use as a roadway to allow the present and all future owners of the Farm Property to have <br />access across the Residence Property for the purposes of servicing, maintaining or replacing <br />the irrigation well located in the pivot comer directly East of the Residence Property, said <br />easement to be Sixteen Feet (16') in width and Eight Feet (8') either side ofa line legally <br />described as follows: commencing at the Southwest comer of the Northwest Quarter (NW /4) <br />of said Section Twenty-seven (27); thence NOooOO'OO"E (assumed bearing) along the West <br />line of said Northwest Quarter (NW/4) a distance of 397.26 Feet; thence N90000'00''E <br />perpendicular to the West line of said Northwest Quarter (NW/4) a distance of Forty Feet <br />(40') to the place of beginning; thence S64001 '46"E a distance of One Hundred Sixty-five <br />Feet (165') to a point; thence S00044'53"E a distance of One Hundred Thirty Feet (130') to a <br />point: thence S20014' 19"E a distance of Forty Feet (40') to a point; thence SOooOO'OO"W <br />parallel with the West line of said Northwest Quarter (NW/4) a distance of One Hundred <br />Forty-eight Feet (148.00') to a point; thence N89041 '50"E along a line parallel with and <br />Eight Feet (8') North ofthe South line of said Northwest Quarter (NW/4) a distance of Two <br />Hundred Eighty-one and Fifty-nine Hundredths Feet (281.59') and terminating at this point. <br />The Owner ofthe Residence Property shall not plant crops, vegetation or trees or construct <br />any improvements or structures on the easement which will interfere with vehicular traffic. <br />The owner of the Residence Property shall mow grass and weeds along the easement. <br /> <br />DUNMIRE, FISHER & HASTINGS <br />Law Offices <br />
