<br />(24), IN BLOCK FOUR (4), BLAIN ADDITION, AN ADDITION TO
<br />THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA, excepting
<br />a certain tract more particularly described in Survivorship
<br />Warranty Deed recorded as Document No. 97- 100657 and
<br />excepting a certain tract more particularly described in
<br />Survivorship Warranty Deed recorded as Document No. 98- 101836
<br />together with all buildings, improvements, fixtures, accessories
<br />and appurtenances thereto belonging.
<br />To have and to hold the above - described property unto the
<br />GRANTEE, its heirs, devisees, personal representatives, successors
<br />and assigns.
<br />This conveyance is made pursuant to the powers conferred upon
<br />the TRUSTEE by a certain Deed of Trust dated October 1, 1998,
<br />executed by FIVE POINTS BANK, a Nebraska Corporation, as TRUSTEE,
<br />and LORETTA A. DANIEL, a single person, and VICTOR J. POWERS, a
<br />single person, as BENEFICIARIES, recorded October 2, 1998, in the
<br />office of the Hall County Register of Deeds, Grand island,
<br />Nebraska as Document No. 98- 109662 of the records of said office,
<br />to secure the payment of one certain Promissory Note in the
<br />original amount of EIGHTEEN THOUSAND FIVE HUNDRED DOLLARS
<br />($18,500.00) and interest as therein provided.
<br />Default has occurred under the terms of said Deed of Trust
<br />and the obligations secured thereby, as more particularly set
<br />forth in the Notice of Default recorded June 30, 2005, in the
<br />office of the Register of Deeds, Hall County, Nebraska and entered
<br />as Instrument No. 0200505953.
<br />On July 5, 2005, a copy of the Notice of Default, with the
<br />recording data shown thereon, was mailed to the TRUSTORS and all
<br />interested parties by certified mail, return receipt requested,
<br />postage prepaid, to the addresses shown in the Affidavit dated
<br />July 6, 2005.
<br />After the lapse of not less than One (1) month, FIVE POINTS
<br />BANK, Grand Island, Nebraska, TRUSTEE, in consequence of the
<br />Notice of Default and in compliance with the terms of the Deed of
<br />Trust, did execute a Notice of Trustee's Sale, stating that the
<br />above- described real property would be sold at public auction to
<br />the highest bidder for cash on the first floor of the Hall County
<br />Courthouse in the City of Grand Island, Hall County, Nebraska, on
<br />September 26, 2005, at 10:00 o'clock A.M. The Notice of Trustee's
<br />Sale was published in the Grand Island Independent, Grand Island,
<br />Nebraska, a newspaper having general circulation in Hall County,
<br />Nebraska, with the first publication being on August 11,2005, and
<br />thereafter on August 18, 2005, August 25, 2005, September 1, 2005,
<br />and September 8, 2005.
<br />On August 18, 2005, a copy of the Notice of Trustee's Sale
<br />was mailed to the TRUSTORS and all interested parties by certified
