<br />200804831 <br /> <br />(a) nothing in this paragraph shall be or be deemed to be a release or <br />impairment of said indebtedness or the lien created by this Deed of Trust upon the Project, or any <br />Pledge Agreement delivered by Borrower, or preclude Bank from suing pursuant to the <br />Reimbursement Agreement and foreclosing this Deed of Trust and all other collateral delivered <br />in support of the Obligations in case of any Event of Default hereunder; <br /> <br />(b) this section shall not release Borrower from liability to Bank for the <br />application of any funds received by Borrower in violation of the covenants contained in this <br />Deed of Trust or in any other document executed in connection herewith; <br /> <br />(c) this section shall not preclude Bank from securing a deficiency judgment <br />from any party who subsequently assumes the payment of the Obligations or as against any other <br />person or persons or entity who may hereafter become liable for the payment of the Obligations; <br />and <br /> <br />(d) nothing contained herein is intended to relieve, release, or discharge <br />Borrower from liability to Bank for application of any funds received by Borrower in violation <br />of the covenants and provisions contained in the Reimbursement Agreement, in the Deed of <br />Trust, or in any other Loan Document executed in connection herewith. <br /> <br />9.23 Organizational Number.
