<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That, Ann M. Beckmann, a married woman dealing in her sole and separate property, whose address is 6025 Gun
<br />Barrel Road, Grand Island, Nebraska 68801 of the County of Hall and State of Nebraska ("Grantor"), for themselves,
<br />their heirs, successors, or assigns, for and in consideration of the sum of ($5.00) Five Dollars, receipt and adequacy of
<br />which consideration are hereby acknowledged, do hereby grant, convey and confmn unto SourceGas Distribution LLC,
<br />whose address is 370 Van Gordon Street, Suite 4000, Lakewood, CO 80228, its successors and assigns (collectively,
<br />"Grantee"), the right-of-way and easement to survey, construct, install, inspect, maintain, renew, repair, remove, replace
<br />and operate cathodic protection units and related equipment in, on, over, under, upon and through the following described
<br />lands situated in the County of Hall and State of Nebraska, to wit:

<br />TOWNSHIP 9 NORTH - RANGE 9 WEST. 6th P.M.
<br />Section 20: A tract of land located in the SW/4NW/4 more fully described as
<br />follows: Beginning at a point of intersection between the east right-of~way line of Highway #28land the south line of
<br />the SW/4NW/4, thence east 100 feet along the south line of said SW/4NW/4. Thence continuing north 30 feet,
<br />parallel to the west line of said SW/4NW/4. Thence west 100 feet, parallel with the south line of said SW/4NW/4 to
<br />the east right-of-way line of Highway #281. Thence south 30 feet along the east right-of-way line of Highway #281
<br />back to the point of beginning and terminating at that point.
<br />
<br />TO HAVE AND TO HOLD said right-of-way and easement unto Grantee so long as said facilities, or any part thereof,
<br />shal(be maintained, together with the right of ingress to and egress from said lands for the purposes herein stated at will of
<br />Grantee. Grantor retains the right to use and enjoy said lands subject only to the right of Grantee to use and occupy the
<br />same for the purposes herein expressed.
<br />
<br />Grantee agrees to pay Grantor for damages to growing crops, fences, or other improvements which may arise from
<br />operations of Grantee. Any such damages, if not mutually agreed upon, shall be ascertained and determined by three
<br />disinterested persons, one appointed by Grantor, one by Grantee and the third chosen by the two so appointed. The written
<br />award of a majority of such three persons shall be final and conclusive upon the parties hereto.
