Smith, being first duly sworn, deposes and states those facts of which he <br />has personal knowledge as set forth hereinbelow: <br /> <br />1. <br />Nebraska. <br /> <br />That Affiant is a licensed attorney authorized to practice law in the State of <br /> <br />2. That Affiant represents Wells Fargo Bank, N.A. in its capacity as Trustee of the <br />James B. BeltzerFamily Trust created pursuant to ARTICLE VII, Paragraph D., of the James B. <br />Beltzer Revocable Insurance Trust Agreement dated January 10, 1991, as amended March 30, <br />1994. <br /> <br />3. That pursuant to the terms of the aforesaid James B. Beltzer Family Trust, Anita <br />B. Beltzer and Norwest Bank Nebraska, N.A. (now known as Wells Fargo Bank, N.A.) were <br />designated as Co-Trustees with the further provision at Article IX, of said Trust Agreement, that <br />upon the death of Anita B. Beltzer, Norwest Bank Nebraska, N.A. (now known as Wells Fargo <br />Bank, N.A.) shall continue to serve as sole Trustee without necessity of replacement. <br /> <br />4. That on January 12,2008, Anita B. Beltzer died, as evidenced by the attached <br />certified copy of her death certificate and pursuant to the provisions ofthe James B. Beltzer Family <br />Trust Agreement, Wells Fargo Bank, N.A. has continued to serve as sole Trustee of said James B. <br />Beltzer Family Trust from and after date of the death of Anita B.
