Goatley and Albert Johnson, husband and wife (hereinafter collectively "Affiants") being first duly sworn upon their oath, depose and say: That by Warranty Deed on July 19, 2005 recorded as Instrument No. 200507068 in the Office of the Register of the Deeds of Hall County, Nebraska, the following described property was transferred to Affiant Alicia Goatley, as: The East Half of the West Half (E 1/2 W 1/2) of Block Fifteen (15) in Windolphs Addition to the City of Grand Island, Hall County, Nebraska That Affiants executed and delivered that certain Warranty Deed (hereinafter "Deed") to Beneficial Nebraska, Inc., dated the ~day of ~br""\i ' 2008, conveying the real estate, above described. That aid Deed lS an absolute conveyance of title to the said property to Beneficial Nebraska, Inc. (hereinafter "Grantee"), in effect as well as in form, and was not and is not intended as a mortgage, trust conveyance, or security of any kind; that possession of said property has been surrendered to Grantee, and that the consideration for said Deed is: (1) the full cancellation of all notes, bonds, obligations, costs and charges secured by a certain Deed of Trust (in default) heretofore existing -1- Steffi A.
