Goatley and Albert Johnson, husband and wife <br />(hereinafter collectively "Affiants") being first duly sworn upon <br />their oath, depose and say: <br />That by Warranty Deed on July 19, 2005 recorded as Instrument <br />No. 200507068 in the Office of the Register of the Deeds of Hall <br />County, Nebraska, the following described property was transferred <br />to Affiant Alicia Goatley, as: <br />The East Half of the West Half (E 1/2 W 1/2) of Block Fifteen <br />(15) in Windolphs Addition to the City of Grand Island, Hall <br />County, Nebraska <br />That Affiants executed and delivered that certain Warranty <br />Deed (hereinafter "Deed") to Beneficial Nebraska, Inc., dated the <br />~day of ~br""\i ' 2008, conveying the real estate, above <br />described. That aid Deed lS an absolute conveyance of title to <br /> <br />the said property to Beneficial Nebraska, Inc. <br /> <br />(hereinafter <br /> <br />"Grantee"), in effect as well as in form, and was not and is not <br />intended as a mortgage, trust conveyance, or security of any kind; <br />that possession of said property has been surrendered to Grantee, <br /> <br />and that the consideration for said Deed is: <br /> <br />(1) the full <br /> <br />cancellation of all notes, bonds, obligations, costs and charges <br />secured by a certain Deed of Trust (in default) heretofore existing <br /> <br />-1- <br /> <br />Steffi A.
