WITNESSETH: WHEREAS, Borrower did e~ecuteacerta~e4o-th.e order ef,theL~~,U1e original amount of ONE HUNDRED FIFTY THOUSAND ONE HUNDRED SIXTY and No/IOO Dollars ($150,160.00), dated March 8, 200" ~ WHEREAS, the Note described above was secured by a Deed of Trust dated March 8, 2006, ftled of record in the Office of the Hall County Register of Deeds on March 14, 2006, as Instrument no. 200602241 which included that real estate described as: SEE ATTACHED EXHIBIT A WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust identified hereinabove to extend its maturity by reason of the execution and delivery of a new Note evidencing the replacement of the original Note that contained a stated maturity date that the parties now agree should be extended to allow for repayment of the debt as evidenced in such replacement Promissory Note; NOW, THEREFORE, it is agreed: 1. Security for New Instrument of Indebtedness. The indebtedness described in the Deed of Trust identified above, shall from the date hereof secure a Note in the amount of One hundred Fifty-Six Thousand Seven Hundred Ninety-One and 50/1 00 Dollars ($156,791.50) of even date herewith, together with all renewals, modifications and extensions thereof and any and all future advances and retadvances thereof. 2. Modification of Date of Stated Maturitv. The Maturity Date in respect to the indebtedness to be secured the Deed of Trust hereby modified is extended from March 27,2007 to May 1,2038. 3. Continuing Effect. Except as specifically modified by this Deed of Trust Modification Agreement, all other terms and provisions of the Deed of Trust hereinabove identified shall remain in full force and effect. 4. Effect on other Security. All real estate mortgages, deeds of trust, assignments and security agreements heretofore or concurrently herewith to be granted shall remain m full force and effect to the extent not inconsistent with this Deed of Trust Modification Agreement and shall continue as security for Borrower's remaining indebtedness previously existing and additional indebtedness hereinabove set forth until such sum shall be paid, as well as any future indebtedness owing from Borrower to the Lender for future advances and renewals in respect to all sums owing from Borrower to Lender.
