Thanpson Kirkpatrick, fonnerly Gale R. Thanpson, single, being first <br />duly sworn, deposes and says: <br /> <br />That she is thp identical person who executed and delivered that certain <br />Warranty Deed to Norwest Bank Grand Island, N.A., dated the3rd day of December <br />1984, conveying the following-described property: <br /> <br />Lot Eighteen (18), Freedom Acres Subdivision, <br />Hall County, Nebraska. <br /> <br />That the aforesaid Deed was an absolute conveyance of the title to said premises <br />to the Grantee named therein in effect, as well as in fonn, and was not and is not <br />now intended as a mortgage, trust conveyance, or security of any kind, and that <br />possession of said premises has been surrendered to the said Grantee; that the <br />consideration in the aforesaid Deed was and is the release of personal liability <br />fran the Promissory Note and Mortgage recorded as Docunent No. 78-000142; that the <br />amount of liability released equals or exceeds the equity value of the above- <br />described real estate; and receipt of said consideration is hereby acknowledged <br />by said Grantor. <br /> <br />'me aforesaid Deed of conveyance was made by her as the result of her request <br />~~=::.::~:: (:=~t==: ~~.:c~-~ ::;~i~ -Dc,:d - ancl;.;a~-l:~:-'..,,"ol~ts&./"&-c~;~but-~~ ~:-.e- time -of <br />making said Deed she felt and still feels that the indebtedness above mentioned <br />representing the principal, interest, and advances under the terms of the Note and <br />Mortgage above referenced represented a fair value of the property so deeded; that <br />said Deed was not given as a preference against any other creditors; that at the <br />time it was given, there was no other person or persons, firms or corporations, <br />other than the Grantee therein named interested, either directly or indireetly..in <br />said premises except for The Equitable Building and !.Dan Association of Grand Is-. <br />land, Nebraska, holder of a first mortgage recorded as Docll11el1t No. 76-005476, <br />which the Grantee herein assunes and agrees to pay; that she is solvent and haa <br />no other creditors whose rights would be prejudiced by such conveyance,8l'ld that <br />she is not obI igated upon any lxmd or other mortgage or by any lien has been <br />created or exists ~ainst the premises described in said Deed except the ~. <br />to The Equitable Bullding and Loan Association of Grand Island, Nebraska, <br />above; and that in ordt~r to execute the aforesaid Deed to the Grantee t <br />n executing the same, she was not acting under any misapprehension H to <br />t.ereof, or tnder any duress, undue i:-..:luence, or misrepresentation by <br />or the agent or attorney of the Grantee in said Deed, and that it washer <br />as c..;rantor in saiL Deed to convey and by said Deed did convey therein atl <br />title, and interest, absolutely in and to the premises described in said <br /> <br />This Affidavit is made for the protection and benefit of the af <br />in said Deed, its SUCCI~ssors and assigns, and all other parties hereafter <br />with or who may acquire an interest in the property deKribed therein, aDd:&l <br />bind the heirs, personal representatives. and assigns of the unders1ped. <br /> <br />STATE OF ~ ) <br /> <br /><::xUm' OF HALL ) <br /> <br />Q:l this 3rd day of December , 1984, before me a Notary PUblic in and <br />for !laid Coont.yiIDd St...te, personally appeared Gale R. ~ Kirkpmick, to <br />..
