COFFEY, SHERRY . fFEY an <br />TRUSTORS. whose address is P.o. Box 81463, Lincoln, Nebraska <br />~8~ ; PATRiCK L. ~~ID, as Trustee; and <br />DOLL, INC.. whose address is P.O. Box 927, Grand Island, <br />Nebraska, as Beneficiary. <br /> <br /> <br />WITNESSETH: <br /> <br />That Trustors convey, sell, and warrant to Trustee in trust, <br />with power of sale, the following described real property: <br /> <br />Lots Nine (9) and Ten (10), Block Eleven (11), H.G, <br />Clark's Addition, Grand Island, Hall County, Nebraska <br /> <br />The intention being to convey hereby an absolute title in fee <br />simple. together with all buildings, fixtures, improvement~, and <br />appl'_tenances thereto belonging. <br /> <br />The Trustors covenant and agree with the said Trustee and <br />Beneficiary that they are lawfully seised of said premises; that <br />they have good, right and lawful authority to sell and convey said <br />premises; that said premises are free and clear of all liens and <br />encumbrances; and that Trustors will warrant and defend the title <br />to said preoises unto the Trustee and his successors and assigns <br />forever against the claims of all persons. <br /> <br />FOR THE PURPOSE OF SECURING performance on each agreement of <br />Trustors herein contained and the payment of Fifty-two Thousand <br />Dollars ($52,000.). as evidenced by a promissory note bearing <br />even date at a fourteen percent (14%) per annum rate of interest <br />until paid; a final payment of the principal sum and all accrued <br />interest shall be payable on the 1st day of December, 1989. <br /> <br />It is agreed by and between the parties hereto that while <br />~itle is vested in the Trustee and until filing of the Notice of <br />l~fault, the Trustors shall: <br /> <br />A. Retain possession of the premises and collect the <br />rents and revenues therefrom. <br /> <br />B. Maintain the buildings and improvements located <br />thereon in good condition and repair. <br /> <br /> <br />C. Pay all taxes and special assessments levied or <br />assessed against or due upon said pr~ises before <br />delinquency, and to deliver to Beneficiary copies <br />of receipts showing payment of such taxes, <br /> <br />D. Procure and maintain policies of insurance against <br />the usual hazards of fire, hail, windstorm, and <br />other similar risks, in sums and underwritten by <br />companies acce-ptabJe to the Beneficiary, with Iou <br />payable to the parties as th~ir interest may appear. <br /> <br />E.
