In case the Trustee, or the Issuer with the written consent of Trustee, shall have proceeded to enforce its rights here- under and such proceedings shall have been discontinued or abandoned for any reason or shall have been determined adverse- ly to the Trustee or Issuer, then and in every such case the Company, the Trustee and the Issuer shall be restored respectively to their several positions and rights hereunder, and all rights, remedies and powers of the Company, the Trustee and the Issuer shall continue as though no such proceeding had been taken. " Section 9.4. Agreement to Pay Attorneys' Fees and Expenses. In the event Company Should a au t under any of the provisions of this Agreement and Trustee or Issuer should employ attorneys or incur other expenses for the collection of Lease Payments or the enforcement of performance or observance of any covenant, condition, obligation or agreement on the part of Company herein contained, Company agrees that it will on demand therefor pay to Trustee or Issuer the reasonable fee of such attorneys and such other expenses so incurred by Trustee or Issuer.
