ORDINANCE NO. 7217 (Contd) BJr r <br />QQEj'�►�r� <br />Subdivision to the East right-of-way line of Independence <br />Avenue; thence South on the East right-of-way line of <br />Independence Avenue to the South line of Section 2, Township <br />11 North, Range 9 West of the 6th P.M.; thence continuing <br />South a distance of 33.0 feet; thence West parallel to and <br />33.0 feet South of the South line of Section 2 to a point <br />33.0 feet South and 33.0 feet East of the Southwest corner <br />Of Section 2; thence North a distance of 33.0 feet to the <br />point of beginning, all as shown on the plat marked Exhibit <br />"A" attached hereto and incorporated herein by reference. <br />SECTION 4. Said improvements shall be made in accordance <br />with plans and specifications prepared by the Engineer for the <br />City which have been filed with the City Clerk. The Engineer for <br />the City has also filed with the City Clerk an estimate of the <br />total cost of the proposed project. Bids for the construction of <br />such sanitary sewer shall be taken and contracts entered into in <br />the manner provided by law. <br />SECTION 5. The cost of construction of such improvements <br />shall be assessed against the property within the district <br />abutting upon the street or other right -of -way within which such <br />sanitary sewer main will be constructed within such sewerage <br />district to the extent of benefits to such property by reason of <br />such improvement, and a special tax shall be levied at one time <br />to pay for such cost of construction as soon as can be <br />ascertained, as provided by law; and, provided further, such <br />special tax and assessments shall constitute a sinking fund for <br />the payment of any bonds with interest issued for the purpose of <br />paying the cost of such sewer in such district; such special <br />assessments shall be paid and collected in a fund to be <br />designated and known as the Sewer and Water Extension Fund, and <br />out of which all warrants issued for the purpose of paying the <br />cost of such sanitary sewer shall be paid. <br />SECTION 6. Ordinance No. 7085 and any other ordinances of <br />the City of Grand Island in conflict herewith are hereby <br />f repealed. <br />SECTION 7. This ordinance shall be in force and take effect <br />from and after its passage, approval, and publication, without <br />the plat, as provided by law. <br />61 <br />
