<br />EASEMENT
<br />THIS INDENTURE made this A@ day of November, 1985, between
<br />R.G.B. FARMS LIMITED PARTNERSHIP, A Nebraska Limited Partnership,
<br />hereinafter referred to as "Grantor," and DONALD R. SPIEHS and
<br />BEULAH G. SPIEHS, Husband and Wife, as joint tenants, hereinafter
<br />called "Grantee," whether one or more.
<br />W I T N E S S E T H
<br />That said Grantor, in consideration of the sum of SEVENTY
<br />FIVE DOLLARS ($75.00) and other valuable consideration to Grantor
<br />in hand paid by said Grantee, the receipt whereof is hereby
<br />acknowledged, does hereby grant, sell, convey and confirm unto
<br />said Grantee and assigns forever, a utility line easement for
<br />the right to use, construct, build, lay, maintain, repair and
<br />construct a gas pipe line for the passage of natural gas,
<br />together with all appurtenances, structures, and other applicable
<br />equipment pertaining thereto, in, through and under the parcel of
<br />land described as follows, to -wit:
<br />A tract of land eight foot (8') in width along and
<br />adjacent to the entire eastern boundary of the
<br />East Half of the Southwest Quarter (E 1/2 SW 1/9)
<br />of Section Three (3), Township Nine (9) North,
<br />Range Nine (9), West of the 6th P.M., Hall County,
<br />Nebraska.
<br />No buildings, improvements, or structures shall be placed in,
<br />on, over or across said easements by the undersigned, its
<br />successors and assigns, without express approval of the Grantee.
<br />Any trees, crops, and shrubbery placed on said easement shall be
<br />maintained by Grantor, its successors and assigns.
<br />No construction or maintenance of tl,e gas line herein
<br />described shall take place while a crop is in the field, unless
<br />said construction or maintenance has the prior consent of
<br />Grantor, its successors or assigns.
<br />Said Grantor, for itself and its successors and assigns, does
<br />confirm with the said Grantee and assigns that it, the Grantor,
<br />is well seized in fee of the above - described property, and that it
<br />has the right to grant and convey this easement in the manner
<br />and form aforesaid, and that it will, and its successors, assigns
<br />and administrators shall, warrant and defend this easement to
<br />said Grantee and their assigns against the lawful claims and
<br />demands of all persons. This easement runs with the land.
