85- 005862 ACKNOWLEDGEMENT The undersigned, BISON INVESTORS V LIMITED PARTNERSHIP, BY: PONDEROSA ESTATES, INC., GENERAL PARTNER, identified as ' Trustor" under a certain Deed of Trust Construction Security Agreement dated November 26, 1985 in respect to that real estate described as: Lot Four (4), Block Nine (9), Continental Gardens, an addition to the City of Grand Island, Hall County, Nebraska; to be entered into among Trustor; Arend R. Baack, Attorney at Law, '"Trustee "; and The Overland National Bank of Grand Island, Beneficiary, hereby acknowl- edges that this Acknowledgement is made prior to its execution of that Deed of Trust Construction Security Agreement and that it knows and understands that (a) the Deed of Trust Construction Security Agreement to be executed by Trustor is P Trust Deed and not a Mortgage and (b) that the power of sale provided for in the Deed of Trust Construction Security Agreement provides essentially different rights and obligations to the Trustor than a Mortgage in the event of default or breach of obligation.
