<br />SUBORDINATION AGREEMENT
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />WHEREAS, Patrick L. Fitzgerald and Rita A. Fitzgerald,
<br />husband and wife, have executed a Mortgage on the following -
<br />described premises:
<br />Lot Nine (9), Block Two (2), in Colonial Estates
<br />Subdivision, City of Grand Isalnd, Hall County,
<br />Nebraska,
<br />to The Equitable Building and Loan Association of Grand Island,
<br />Nebraska, in the original amount of Forty-Seven Thousand, Five
<br />Hundred Dollars ($47,500.00), which Mortgage was recorded as
<br />Document No. 81- 004307; and,
<br />WHEREAS, said Mortgagors desire to refinance the debt and
<br />execute a new Mortgage to The Equitable Building and Loan Associa-
<br />tion of Grand Island, Nebraska, in the amount of $47,000.00, in
<br />return for the release of the original mortgage, Document No. 81-
<br />004307; and,
<br />WHEREAS, the new Mortgage will be recorded as Document No.
<br />in the Register of Deeds Office, Hall County, Nebraska;
<br />and,
<br />W1IEREAS, the said Mortga „ors have executed two Mortclages
<br />and an Extension Agreement to Five Prints Bank as follows:
<br />Mortgage filed September 4, 1981, as Document No.
<br />81-004550; Mortgage filed ,kpril 19, 1482, as
<br />Document No, 82- 00141;7; and Modification and fix -
<br />tension Agreement filed May 6, 1985, as Document
<br />No. 85-0021 6 5, and ; modification and 12-Ntension Aqreer.ient
<br />filed Auqust 26, 1985 as C ,m_nt No. 85- 004094; and,
<br />WHEREAS, the undersigned 'rive Points Bank a4trees that
<br />the new retinancing Mort,, age= to The Equitable Building and
<br />Lean Association of Grand Island, Nebraska, is a first and prior
<br />lien upon said premises.
<br />NOW, THEREFORE, i::,r v,sluablo c•onsidoration, receipt of which
<br />is hereby acknowledged, the undersigned, Five Points Bank, acknow-
<br />ledges the priority c,f thil new rot inanci TIC' Mortgage to 'Ihe EquiL-
<br />able Building and Loan Association of Grand Island, Nebraska, and
<br />specifically subordinates ti:e liens of the Five Points Bank, re-
<br />corded as Document Nos. 81-004550, 82- 001487 and 85- 002165 to the
<br />lien of the new refinancing Mortgage 1c, The Equitable Building
<br />and Loan Association of Grand Island, Nebraska, recorded as Docu-
<br />ment No. $5- 005518_
<br />The undersigned, by the faXecuti;yn of this Subordination
<br />Agreement, do riot. release the lien of its mortgages in any partic-
<br />ilar, but only subordinates such 1i-,ns to the new mortgage of
<br />The Equitable Building; and Lean Associatit,,n of Grand t5land, Ne-
<br />braska.
