85== 005085 AFFIDAVIT STATE OF NEBRASKA, COUNTY OF HALL: Under oath, I declare: 1. I am the same person as Richard D. Senkbeil, Sr., who created the R & D Foundation Trust by a Declaration of Trust duly filed in the Office of the Register of Deeds of Hall County, Nebraska, on September 20, 1979, recorded as Document No. 79- 006201. 2. I am the sole beneficiary of the R & D Foundation Trust referred to in Paragraph 1 of this Affidavit and consent to the conveyance by the Trustees, Richard D. Senkbeil, Jr. and Scott Robert Senkbeil, to Michael C. Nelsen and Jolyne K. Nelsen, husband and wife, as joint tenants and not as tenants in common, of the following described real estate constituting a part of the Trust assets: Lot One (1), in Block Three (3), in Valley View Sub- division, in the City of Grand Island, Hall County, Nebraska, as surveyed, platted and recorded, and The Westerly Thirty (30) feet of the Northerly one hundred fifty (15.0) feet of that portion of vacated Short Street, from the north right of way line of Phoenix Avenue to the South right of way line of Oklahoma Avenue in the City of Grand Island, Hall County, Nebraska, as surveyed, platted and recorded, subject to easements, covenants, conditions, reservations and restrictions of record. 3. Dorothy D. Senkbeil, one of the Trustees originally named in the Declaration of Trust creating the R & D Foundation Trust referred to in Paragraph 1 of this Affidavit, died on March 11, 1979, and she was succeeded as Trustee by Scott Robert Senkbeil. 4. I know of my own personal knowledge the taxable assets owned by Dorothy D. Senkbeil, as of the date of her death on March 11, 1979, did not exceed the amount of credit allowable for the United States estate and gift taxes as of the date of her death and that all such credit was available to her as of that date. i (Richard D.
