85- 004913 <br />SUBORDINATION OF MORTGAGE TO EASEMENT GRANT <br />KNOW ALL MEN BY THESE PRESENTS that, <br />WHEREAS, Metropolitan Life Insurance Company, a corporation <br />of the State of New York, is the owner and holder of a certain <br />mortgage from Back -Bar Farm Co. of Nebraska, a Nebraska corpo- <br />ration, to Metropolitan Life Insurance Company, a corporation of <br />the State of New York, dated June 4, 1981, recorded in the Office <br />of the Register of Deeds of Hall County, Nebtraska, as Document <br />No. 81- 403399 securing an indebtedness originally in the amount <br />of $120,000.04 and, <br />WHEREAS, Back -Bar Farm Co. of Nebraska has executed a <br />perpetual easement over and upon certain of the property subject <br />to the said mortgage, which perpetual easement is to Platte River <br />Whooping Crane Critical Habitat Maintenance Trust, Inc., a <br />Nebraska non - profit corporation, and such easement grant was <br />dated November 23, 1984, and, <br />WHEREAS, Platte River Whooping Crane Critical Habitat <br />Maintenance Trust, Inc., insists that part of the consideration <br />in addition to the easement grant itself for which Platte River <br />Whooping Crane Critical Habitat Maintenance Trust, Inc., is <br />paying Back -Bar farm Co, of Nebraska valuable consideration, that <br />Back -Bar Farm Co. of Nebraska would obtain a subordination <br />agreement from Metropolitan Life Insurance Company, subordinating <br />the mortgage In existence as filed against that property described <br />as follows: <br />Lots Three (3), Four (4), Five (5) and the Southwest Quarter <br />(SW,) of Section Thirty -six f36), -_ownshia Ter, (10) North, <br />Range Ten (10) West of the 6th P.M., mall County, Nebraska, <br />to the easement grant. <br />NOW, THEREFORE, in consideration of the =remises and the sum <br />of One Dollar f$1.00) paid by Back -Bar Farm Co. o, Nebraska, to <br />Metropolitan Life Insurance Company, Metropolitan Life _assurance <br />Company, a corporation of the State of New York, does hereby_ <br />waive the priority of the above- mentioned mortgage over the <br />easement grant in favor of Platte Crane Whooping Crane Critical <br />Habitat Maintenance Trust, Inc., intending hereby that the rights <br />4 <br />Q}Q} <br />„tee <br />� <br />i <br />
