85-004520 1 MODIFICATION AND EXTENSION ACRE OU THIS MODIFICATION AND EXTENSION AGREEMENT made and executed this loth day of _C�-,prPmhPr , 1985, by and between DAVIS BROS. OONSTRIJCTION CD., also known as DAVIS BROTHERS CONSTRUCTION OaMPANY, hereinafter called the 'Borrower ", and THE OVERLAND NATIONAL BANK OF GRAND ISLAND, NEBRASKA, hereinafter called the "Lender ". W I T N E S S E T H: WHEREAS, the Borrower has executed a certain Mortgage Note dated August 8, 1983; WHEREAS, there is presently outstanding a remaining principal sum in respect to said Mortgage Note in the amount of Fifty Thousand and No /100 Dollars ($50,000.00); WHEREAS, said Mortgage Note has an original maturity date of 11a.rch 1, 1984; WHEREAS, Borrower has made application to the Lender to extend the date of maturity in respect to said Mortgage Note to Decenber 1, 1985; and WHEREAS, Lender has agreed to extend the time for payment in respect to such Mortgage Note contingent upon Borrower continuing to make the payments are required by said original Mortgage Note as accrue from the date hereof until the maturity date as extended. NOW, TUMEYDRE, in consideration of the mutual covenants herein contained, it is agreed: 1. The Lender does agree, upon and subject to these terms, pro- visions and conditions, to extend the time for payment by the Borrower of the principal sum of Fifty Thousand and No1100 Dollars ($50,000.00) remaining due and owing in rcxpect to that '.fort „age Note dated August 8. 1983. Lender further agrees to extend the time for payment of the remaining principal balance on said Mortgage Note to December 1, 1985, at which time the entire then remaining principal balance, together with accrued interest at the rate of thirteen and one -half percent (13.50`yo) per annum, shall be clue and payable in full. 2.
