L <br />85- 00424,1 <br />hereditaments, appendages and appurtenances thereunto belonging <br />or in anywise appertaining; (3) all right, title, interest and <br />estate of First Party in and to streets, roads, ways, sidewalks, <br />curbs, alleys, and areas adjoining said Real Estate and portions <br />thereof, and whether vacated by law or ordinance (conditionally <br />or otherwise); (4) all rents, revenues, income, issues and <br />profits, which are hereby specifically assigned, transferred, <br />pledged primarily and on a parity with said Real Estate; and <br />(5) all materials, supplies, plans and specifications, fixtures, <br />fixed assets, and personalty now or at any time hereafter <br />annexed, affixed or attached to said Real Estate and /or said <br />buildings, improvements or structures thereon and all other <br />personal property owned by First Party and used or intended to <br />be used in the construction, possession, occupation, or <br />enjoyment thereof, or otherwise now or hereafter located <br />thereon, and • all replacements, additions, and substitutions <br />thereof or thereto, including (but without limiting the <br />generality of the foregoing) all apparatus, appliances, <br />machinery, equipment, and articles used to supply or provide, or <br />in connection with heat, gas, air conditioning, plumbing, water, <br />lighting, power, elevator, sewage, refrigeration, cooling, <br />ventilation and sprinkler systems, water heaters, all window <br />shades, drapes and drapery equipment and apparatus, fire <br />prevention and extinguishing apparatus, security and access <br />control apparatus. <br />As additional security hereunder, and in consideration of <br />the debt and other considerations hereinabove mentioned, First <br />Party does hereby sell, assign, transfer and set over unto <br />Second Party and unto its successors and assigns, upon the terms <br />and conditions hereinabove provided, all of the rents, income, <br />issues and profits from all the authority to collect, receive <br />and receipt for all such rents, income, issues and profits which <br />may become due and payable at any time and from time to time <br />hereafter and to demand, sue for, receive and collect the same <br />and to take and use all legal proceedings and means to recover <br />the same. This description has general reference to any and all <br />leases or subleases covering the above- described premises or any <br />part thereof whether said leases or subleases are presently in <br />existence or hereafter entered into and whether or not said <br />leases or subleases covering the above - described premises or any <br />part thereof whether said leases or subleases are resently in <br />existence or hereafter entered into and whether -or not said <br />leases or subleases are presently subject to assignment. <br />TO HAVE AND TO HOLD the said Mortgaged Property and every <br />part thereof unto said Second Party az:d :.nto its successors and <br />assigns, forever, to secure the payment of the Secured <br />-2- 4431t <br />Li <br />L J <br />1� _J <br />
