r <br />85--- 003 <br />IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND <br />DECREED BY THE COURT AS FOLLOWS: <br />1. Commercial National Bank and Trust Company of <br />Grand Island, Hall County, Nebraska, is hereby formally <br />removed as Trustee of the R -L -R Irrevocable Trust. <br />2. The Grand Island Trust Company of Grand Island, <br />Nebraska, is hereby appointed as Successor Trustee of the R- <br />L-R Irrevocable Trust. <br />3. The real estate which is described on Exhibit "A ", <br />attached hereto and incorporated herein by above reference, <br />which has been held in the name of Commercial National Bank <br />and Trust Company, Trustee, should be and the same hereby is <br />conveyed to the Grand Island Trust Company, as Successor <br />Trustee of the R -L -R Irrevocable Trust. <br />4. The Commercial National Bank and Trust Company is <br />hereby ordered to pay over and deliver to the Grand Island <br />Trust Company, as Successor Trustee, all of the personal <br />property of the R -L -R Irrevocable Trust. <br />5. As Successor Trustee of the R -L -R Irrevocable <br />Trust, the Grand Island Trust Company has the power to <br />perform, without Court authorization, every act which a <br />prudent person would perform for the purposes of the trust <br />including, but not limited to, the Rowers specified in <br />Subsection (2) of Section 30 -2821 of the Revised Statutes of <br />Nebraska, 1984 Cumulative Supplement. <br />6. With respect to the third person dealing with the <br />Grand Island Trust Company as Successor Trustee in the <br />conduct of any transaction, the existence of trust powers <br />and their proper exercise by the Successor Trustee may be <br />assumed without inquiry. The third person is not bound to <br />inquire whether the Successor Trustee has power to act or is <br />properly exercising the power; and a third person, without <br />actual knowledge that the Successor Trustee is succeeding <br />the Successor Trustee's powers or properly exercising them, <br />is fully protected in dealing with the Successor Trustee as <br />if the Successor Trustee possessed and properly exercised <br />the powers such Successor Trustee purports to exercise.
