85, 004148 <br />AGREEMENT <br />THIS AGREEMENT made and entered into this 28th day of August, <br />1985, by and between HOMER E. BRIGGS, Seller under a Contract for <br />Sale of Real Estate dated August lb, 1982, and DAVID D. LANDIS and <br />ROGER L. KEITH, as Purchasers, as follows: <br />1. Purchasers acknowledge that they are in arrears in the <br />payments required under the terms of the Land Sale Contract. <br />2. Seller, as consideration of a Quitclaim Deed from Pur- <br />chasers, will refrain from any attempt to collect payments which <br />may be currently due and owing. <br />3. Purchasers will be permitted to remove from the premises <br />the following items: <br />(a) Chain link fence; <br />(b) Curtains, curtain rods and drapes. <br />4. Purchasers shall be given until September 23, 1985 to <br />vacate the premises. <br />5. Seller and Purchasers hereby authorize and direct Five <br />Points Bank, Escrow Agent, to return the Warranty Deed to the <br />Seller, HOMER E. BRIGGS, and the parties herein absolve Five <br />Points Bank from any liability whatsoever by acting in accordance <br />with this Aqreement. <br />c <br />r <br />HOMER E.
