J, 003846 <br />1. Paving. The Subdivider waives the right to object to <br />any paving or repaving districts of Old Potash Highway and Old <br />Fair Road where they abut the subdivision. <br />2. Water. Public water service is available to the <br />subdivision, and the Subdivider agrees to connect all new <br />structures in the subdivision which require water service to the <br />water main before applying for occupancy permits. <br />3. Sanitary Sewer. Lot One (1) is served by a private <br />sanitary sewer service line. Lots Two (2) and Three (3) may be <br />served by extending a municipal sanitary sewer main located on <br />the north side of old Potash Highway approximately two hundred <br />(200.0) feet west of the subdivision. The Subdivider, or sub- <br />sequent owners, of Lots Two (2) and Three (3) waive the right of <br />protest for the creation of a sanitary sewer district. The <br />Subdivider agrees to connect all new structures in the sub- <br />division which require sanitary sewer service to the municipal <br />sanitary sewer before applying for occupancy permits. The use <br />of septic tanks is not acceptable within the subdivision. <br />4. Drainage. The Subdividers agree to grade the lots of <br />the subdivision in conjunction with the structures thereon so <br />that storm water drains to the public right -of -way, as approved <br />by the City's Director of Public Works. <br />5. Sidewalks. The Subdivider, if still the owner of the <br />land in the proposed subdivision, or if the Subdivider shall have <br />transferred title to the property, then the various grantees <br />thereof will install at their own expense all public sidewalks <br />when and as required by the Grand Island City Council. <br />2 <br />a <br />
