L <br />t <br />r <br />UTILITY EASEMENT <br />BOARD OF AMERICAN MISSIONS OF THE LUTHERAN CHURCH IN <br />AMERICA, herein called the Grantor, in consideration of <br />Twenty Five Dollars and no cents ($25.00) <br />receipt of which is hereby acknowledged, hereby grants and <br />conveys unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation in Hall County, Nebraska, herein called. <br />the Grantee,.a permanent and perpetual easement and right -of -way <br />to construct, operate, maintain, repair, replace, and remove an <br />underground dewatering well and other appurtenances necessary for <br />dewatering well operation and maintenance upon, in, and through a <br />tract of land located in the Southeast Quarter (SE 1/4) of <br />Section Two (2), Township Eleven (11) North, Range Ten (10) West <br />of the Sixth P.M., in the City of Grand Island, Hall County, <br />Nebraska, more particularly described as follows: <br />Beginning at a point fifteen (15) meet West and fifteen <br />(15) feet North of the Southwest corner of Lot One (1), <br />Block Five (5) of Jenkinson Subdivision; thence running <br />westerly along a wine fifteen ( 15 ) feet :North of and <br />parallel to the North right -of -way line of Capital <br />Avenue for a distance of fifteen (15) feet; thence <br />running northerlys along a line thirty (50) feet West of <br />and parallel to the West line of Jenkinson Subdivision <br />for a distance of five (5) feet; thence running <br />easterly along a line twenty (20) feet North of and <br />parallel to the North right -of -way line of Capital <br />Avenue for a distance of fifteen (15) feet; thence <br />running southerly along a line fifteen (15) feet west <br />of and parallel to the West line of Jenkinson Sub- <br />division for a distance of five (5) feet, said tract <br />containing 75 square feet, more or less, as shown on <br />the plat dated 6/26/85, marked Exhibit "A" attached <br />hereto and incorporated herein by reference; <br />together with the following rights, namely, unrestricted ingress <br />and egress under and across such land for the purpose of exercis- <br />ing the rights herein granted, to clear and keep clear of trees, <br />roots, brush, and other obstructions from the surface of such <br />tract. Any such underground dewatering well ant appurtenances <br />placed upon and under such tract of land shall remain the <br />property of the Grantee, and may F >e, rc moved or replaced at any <br />time. <br />
